ESCONDIDO, Calif. -- An illegal immigrant is suing his Escondido employer after he said his employer threatened to deport him after he experienced a gruesome injury.
Leonardo, an illegal immigrant, said his worries began in April at a horse boarding ranch in Escondido, where he worked for more than two years.
When he touched some metal on a horse walking machine, he got a big shock.

I think that illegals SHOULD be able to sue employers for big bucks. The employer is not paying insurance because he/she thinks they can just dump the illegal if they are injured. IF illegals can sue the hec out of their employers...employers will not hire illegals. I know that illegals should not get rewarded for entering illegally....but I think it is more important that the employers feel LEGALLY THREATENED by hiring illegals.

I THINK AMERICAN CITIZEN WHO SUFFER PROPERTY LOSS OR PERSONAL INJURY SHOULD BE ABLE TO SUE EMPLOYERS OF ILLEGALS ALSO.

I LOVE it! I think every illegal alien should sue his/her employer and put them out of business. The ones who want to stay in business will quickly stop hiring illegal aliens and fire any illegals they already have. HIRE AMERICANS!!!

Let the illegals sue and put the money in a special fund for the victims of illegals. There should be no reward for being here illegally. Also this way the illegals would think twice about lying before they filed lawsuits. Most illegals are accomplished liers.

Mayday, that is a WONDERFUL idea! Like the rancher Barnett - who is helping him? His family has lived on that land for generations - so they probably own it outright and probably the only reason he has been able to hold out for so long. That would be the best answer for all these illegal suits.

OK. Illegals should be able to sue employers for really big bucks, BUT for being in the country illegally they have to pay fines out of the money they get. They have to get something otherwise there is no incentive to sue the employer. I dont like it when illegals get settlements either....but in the larger picture, employers would be AFRAID to hire illegals because of all the law suits. No jobs for illegals...no illegals. The settlements could be HUGE based on the fact that the worker is illegal. But part of the settlement would go to a fund in the form of fines. The illegal wont be scared to sue because they will end up with money that they can use to get re started in their birth country. They have to get something otherwise they wont do it. FINALLY, pro illegal groups cant complain about it ...now can they? The only opposition would be from employers who hire illegals, and those numbers are dropping.

Well I disagree with the settlements should be huge thing because many of these suits are against small employers who simply will not survive if they have to make these payouts. So it is known that the illegals and their supporters care nothing about small business in the US if it is owned by a citizen. They themselves are allowed leniency when they start businesses - the same leniency is not allowed to citizens. For example, they are allowed to have handpainted signage but a citizen is forced to pay thousands of dollars for a plastic sign that meets code. So they appear to have a goal of knocking out small businesses with lawsuits because they believe that it is making opportunity for one of their own.
So it is win win win for them.
I also do not think we need to be fair in giving them monies to go home with the lawsuit - that will encourage more suits. Besides, our government is planning on sending more of our tax dollars there to help them create jobs so they will go back.Restitution to Displaced Citizens First!

I would think that if a person was working illegally, then even if the employer had workers comp that illegal worker would not be covered. You have to be within the scope of your employment and if you "lied" about your status then workers comp will not cover you.
Also, this guy admits in court he is illegal - so send him back with his pregnant wife pronto before she downloads.
