Naples City Council today included language in city contracts that would prohibit contractors from hiring undocumented workers.

The decision means all contracts on today’s consent agenda needed to be pulled and amended to include the new language. The verbiage now prohibits contractors from using undocumented employees, said City Attorney Bob Pritt.

Prior to the changes, city contracts asked that contractors adhere to all state and federal guidelines when hiring employees.

    Here's the updated story:

Contractors hoping to work in the city of Naples will have to take extra steps to ensure the immigration status of their employees following action by the Naples City Council on Wednesday.

The City Council decided to included language in city contracts that would prohibit contractors from hiring undocumented workers.

The decision meant all contracts on Wednesday’s consent agenda — typically routine agenda items approved in bulk without council discussion —

needed to be pulled and amended to include the new language. The revised contract language now prohibits contractors from using undocumented employees, said City Attorney Bob Pritt.

The change comes about six months after Councilman Bill Willkomm raised the idea. Willkomm said he asked staff to look into the changes after learning that Bank of America, which the city has an account with, issues credit cards to illegal immigrants.

“I did express concerns about supporting the immigration laws,â€

Contractors say Naples’ crackdown on illegals won’t affect their dealings with city

It’s an honor system, at least at first.

No one needs to show proof of citizenship in order to win a bid, and they may never have to show proof of citizenship on the job.

But Naples is hoping new contract language will keep contractors and consultants hoping to work in the city from hiring undocumented workers.

On Wednesday, the Naples City Council added language to its contracts that explicitly states that contractors and consultants working in Naples must adhere to immigration laws when hiring employees. The language went into effect Wednesday, when several contracts were pulled from the council’s consent agenda and amended to include it.

But Naples City Manager Bob Lee said the language won’t change the bidding process.

Instead, it asks that contractors and consultants keep certification records of all employees on file, and that those records be made available for inspection within 24 hours of being notified.

The revisions state that in addition to state and federal laws, contractors and consultants must fully comply, without limitations to “all provisions of the Immigration Reform and Control Act of 1986 as amended, as well as all related immigration laws, rules and regulations pertaining to proper work authorization in the United States.â€
