LEXINGTON, SC (WIS) - Lexington County deputies say a man and two teenagers are charged with trying to kill a deputy responding to a call about a suspicious vehicle, according to Sheriff James Metts.
Metts says the three opened fire with a 12-gauge shotgun while Deputy Ted Xanthakis and a police dog were in Xanthakis' marked patrol car, at around 3:00am Sunday on Oakwood Drive near West Columbia.
Pellets from the shotgun damaged the door frame and windows on the passenger's side of the patrol car, but Xanthakis and the dog were not injured.
Seventeen-year-old Carlos Alfredo Diaz De Leon and 20-year-old Lucino Guzman Guttierrez are charged with assault and battery with intent kill, and De Leon is also charged with unlawfully possessing a handgun and driving without a valid driver's license.
Detectives will recommend that the 15-year-old boy be prosecuted in family court on a charge of assault and battery with intent to kill. Under South Carolina law, Metts cannot identify the 15-year-old boy because he is a child.
However, Metts did say De Leon, Guttierrez and the 15-year-old boy illegally entered the United States from Mexico.
Metts says Guttierrez is a member of a criminal gang, and detectives are investigating whether De Leon and the 15-year-old boy also are members of the gang. The motive for the shooting incident remains under investigation.
According to deputies, when Deputy Xanthakis arrived at the Oakwood Drive location, he saw three men running towards him. After seeing Xanthakis' marked patrol car, Metts says the men ran towards a perimeter fence at a mobile home park.
One male ran around a shed in order to hide from Xanthakis, Metts said. Xanthakis stopped his patrol car by a clothes line and saw the male point a shotgun towards him.
Metts says Xanthakis began to back up his patrol car, Metts said, and the man turned and ran. As Xanthakis prepared to get out of his patrol car, a shotgun blast damaged the front passenger window of his car. A piece of glass from the window hit Xanthakis in his face.
Deputies later identified De Leon, Guttierrez and the 15-year-old boy as the three males whom Xanthakis encountered on Oakwood Drive, Metts said. Deputies and members of the U.S. Marshals Service fugitive task force took custody of De Leon, Guttierrez and the 15-year-old boy at De Leon's home at about 10:15am. De Leon was carrying a handgun when he was arrested, according to deputies.
After executing search warrants at the homes of De Leon and Guttierrez, deputies recovered items that might have been stolen during vehicle break-ins in Lexington County, Metts said. The items included GPS devices and car stereos.
Metts says eputies also found the shotgun used to shoot at Xanthakis under a barn on Continental Drive near the intersection with Methodist Park Road near West Columbia.
De Leon and Guttierrez are being held at the Lexington County Detention Center awaiting bond hearings. The 15-year-old is being housed on Sunday at a juvenile detention facility on Broad River Road in Columbia.
The sheriff's department will work with U.S. Immigration and Customs Enforcement concerning the immigration status of De Leon, Guttierrez and the 15-year-old boy.
Metts said the case remains under investigation. The sheriff said detectives might file additional charges against the three.

These people are breaking the law and trespassing HERE IN AMERICA DUH!!!!!!!!!!! How do we handle this? WE LOAD THERE ILLEGAL CARCASE'S IN ANYWAY WE CAN AND HAUL THEM BACK WHERE THEY CAME FROM(AGAIN DUH)!!!!!!!!!!!! ANY QUESTIONS??????????

Hmmm...First obvious question is why the deputy didn't return fire? Seems their department needs to invest more in combat training.
