A suspect in the motor vehicle homicide of a 23-year-old Milford motorcyclist may face deportation, in addition to criminal charges.
Immigration and Customs Enforcement has told Milford police it has issued a 'detainer' for Nicholas Dutan Guaman, 34, said Police Chief Thomas O'Loughlin.
The detainer acts as a 48-hour hold, during which time immigration officials can pursue deportation. The hold would take place after criminal proceedings are completed, O'Loughlin said.
O'Loughlin said he contacted federal immigration authorities Sunday in the case.
Guaman, a citizen of Ecuador, is in the U.S. illegally, O'Loughlin said.
Guaman, who lives at 10 Cherry St., Apt. 1, Milford, is charged with numerous offenses in the death of Matthew Denice, 23, who police said was struck by a large pickup truck while riding a motorcycle on Congress Street Saturday, and dragged about a quarter-mile up West Street.
Guaman is expected to be arraigned at Milford District Court Monday. He has been charged with the following: motor vehicle homicide, operating under the influence of liquor, negligent operation, leaving the scene of personal injury and death, possession of open container of alcohol in vehicle, failure to stop for police, unlicensed operation of a motor vehicle, failure to stop or yield, resisting arrest and wanton or reckless conduct creating risk to a child.
According to immigration officials, a detainer allows federal authorities to explore deportation.
According to ICE, in making these decisions, authorities consider a number of factors, such as the person's criminal history, immigration history (such as whether the person was previously deported or has an outstanding removal order from an immigration judge), family ties and other circumstances.
