Judge denies restraining order for immigration activist

CHICAGO - A judge refused Tuesday to issue a temporary restraining order barring officials from deporting an immigration activist who has taken refuge in a church to avoid being sent back to Mexico.
U.S. District Judge Amy J. St. Eve said a restraining order was not warranted but told attorneys to try to work out an agreement on scheduling as the legal battle over whether to deport Elvira Arellano goes forward.
Arellano, 31, was scheduled to surrender to federal authorities for deportation Aug. 15 but instead sought refuge in the Adalberto United Methodist Church in Chicago's heavily Puerto Rican Humboldt Park area.
She has been there ever since and thus far federal officials have not entered the church to take her by force.
"They've been pretty decent about not going in there and getting her," attorney Joseph Mathews said in a telephone interview after the hearing.
Mathews contends that the government should not deport Arellano because that would also effectively deport her 7-year-old son, Saul, thus depriving the boy of his rights as an American citizen.
Mathews filed his request with the court on behalf of the boy Friday.
Arellano was arrested in 1997 shortly after crossing the border into the United States. She was sent back but returned within days.
In 2002, Arellano was arrested again and convicted of working at O'Hare International Airport as a cleaning woman under a false Social Security number.
Later, she emerged as a vocal proponent of immigration reform.

It should say "when" to deport, not "whether" to deport!!

The sad part of all of this is her son is merely a tool she birthed for the sole purpose of obtaining social services and amnesty.

what the CRAP is the problem with our government these days?......we are so afraid of offending someone that we put our own country in danger! i have been to russia where they have NO problem of getting people out that dont belong...im not saying we should be like that country,but why put ourselves at risk of a terrorist?....who knows if maybe she might have been working in a "cell".....

Elvira
She is an illegal and therefore should not have the right to get a restraining order against immigration agents. Who paid for this escapade? I hope its not the taxpayers! We should learn from the Russians and get her butt kicked out of the country without any more expense to taxpayers. She can go fight for better living conditions in Mexico.

They all should stop blaming us for their economic problems and storm the gates in Mexico, Guatamala, Honduras, Brazil and the rest of South America!
We already let in 1million immigrants in legally a year! We are not violating human rights by protecting our nations sovereignty, borders and citizens!

This is so sickening. What's next? Is Bush going to give her a pardon? Our government is so worthless it's pathetic. They just let the illegals do whatever they want and they wonder why we have an illegal alien problem to begin with. If this woman were a US citizen and of white skin, they would have stormed that church and had her in a prison cell by now. Why is our worthless, do nothing government so afraid of offending hispanics and muslims, yet they don't care about holding us to the letter of the law?
Like this incident isn't emboldening the already brazen and arrogant illegals to do more damage and exploit our weak system even more. GGGGGGRRRRRR
