I understand your concerns as we're pretty much on the same page. However, from the little I know of the law, I do believe that this judge actually stepped further than might be allowed should it be challenged. He's not a fed judge for starters and has left the door open for the ACLU. When others are running away from the ACLU, he seems to have been asking for a showdown.
Personally, it's my feeling that he took a chance in making such a statement and going above and beyond what any other has done to date in his position.
