Judicial Watch sues Herndon over aliens
By Christina Bellantoni
THE WASHINGTON TIMES

--------------------------------------------------------------------------------
A national watchdog group announced yesterday it has sued the town of Herndon over its recent vote to establish a formal center for day laborers, many of whom are illegal aliens.
Judicial Watch, a D.C.-based nonprofit public interest law firm, filed the lawsuit yesterday on behalf of six town residents who they say oppose the center.
In its lawsuit, the group requests a permanent injunction to stop Herndon from using taxpayer funds to operate the day laborer center. It also asks a judge to declare the site "unlawful and a violation of federal and state law" because the center will "predominantly" serve illegal aliens.
"Citizens of Herndon want to stop their town government from acting illegally," said Tom Fitton, president of Judicial Watch, which filed the lawsuit in Fairfax County Circuit Court.
The lawsuit also questions whether the center is a violation of a new Virginia law that denies illegal aliens state and local public benefits.
The law, which takes effect Jan. 1, requires state and local governments to verify those seeking non-emergency public benefits are legally present. Judicial Watch argues that employment services qualify as public assistance.
The Herndon Town Council last month approved a proposal by Project Hope and Harmony, a group of churches and community leaders, to open a center for about 150 day laborers in a trailer at the site of the town's defunct police station.
Herndon Mayor Michael O'Reilly, who is a lawyer, said he thinks the council's decision will be upheld.
"It's unfortunate that Judicial Watch has decided to take on this cause, and more unfortunate they are trying to take on a small jurisdiction instead of Arlington County or Montgomery County which already have functioning sites," he said. "If their intention is to close down such centers, it would seem more appropriate to sue an entity that has a site that's up and operational as opposed to one that still has a lot of hurdles to jump through."
The center in Herndon could be open in the next few months.
In court papers, Judicial Watch officials argue that the rent-free use of town property equates to a taxpayer subsidy, although Project Hope and Harmony officials have said they will pay the rent and utilities for the trailer.
Project Hope and Harmony is waiting to find out whether it has received a grant from Fairfax County, which has set aside $400,000 from its $3 billion annual budget to address the region's problems with day laborers. The group is also soliciting private donations, and last month received a $35,000 pledge from a resident.
The staff at the center will not check the immigration status of the workers who use it. However, the staff will advise contractors who hire laborers to inquire about the workers' immigration status.
The residents represented in the lawsuit are Krish Karunakaram, Susan M. Powell, William and Cheryl Smith, George A. Taplin and M. McDowell.

Judicial Watch - Because no one is above the law!
Judicial Watch was started by Larry Klayman who was repeatedly persecuted by both the Clinton and Bush administrations. I see that he resigned in 2003..
They were quite active in the Clinton era.
Here are some of the things that went on. Oh Yeah! I forgot to mention, they made him out to be a nut also. Seems to be their "modus opperendus" for any who go against their agenda.

DOCUMENTS NAIL IRS ON POLITICAL AUDITS
IRS Documents Show Clinton White House, Democrat Congress Involved in Attempted Audit of Judicial Watch
Documents Turned Over Four Years Late
(Washington, DC) Judicial Watch, the public interest group that investigates and prosecutes public corruption, announced today that the IRS released documents showing a direct link between an attempted audit of Judicial Watch and contacts with the IRS by the Clinton White House and key Democrats in Congress. As a result of court litigation, the documents were turned over to Judicial Watch under the Freedom of Information Act (FOIA) on July 8, 2001, nearly four years late. As Robert Novak reported in his column today (“IRS reveals smoking gun, by Robert Novak, July 29, 2002, available by clicking here), included in the documents was a copy of a email to President Clinton at the White House which stated:
I have received solicitation for funds and a questionnaire from Larry Klayman, of Judicial Watch. They have targeted you and the Vice President...I think you and your wife have done a great job in spite of the partisan attacks against both of you.
The IRS documents show the email, which was sent to the IRS Commissioner Charles Rossotti’s office by the Clinton White House, was received by the IRS on or about September 22, 1998. Judicial Watch’s first audit notice was dated two weeks later, on October 6, 1998.
The IRS also finally released various “complaints about Judicial Watch from Democrat members of Congress. Most notable was a February 26, 1999 letter from Congressman Charles Rangel, who signed his letter as “Ranking Democrat on Committee on Ways and Means letterhead. The Rangel letter also mentions Congressman Frost, another House Democrat who has served as Democratic Caucus Chairman. Marcus Owens, who ran the Exempt Organizations Division for the IRS, signed the responses to Rangle and Frost, noting that their materials were being sent to the IRS office “with examination jurisdiction over Judicial Watch. The Owens letter clearly, and improperly, implies that Judicial Watch is under IRS examination. The IRS attempts to audit Judicial Watch continue under the Bush Administration. Judicial Watch is now seeking relief in federal court from the politically-motivated attempted audits. The Bush Justice Department, under the direction of Stuart Gibson (a liberal Democrat-supported officeholder from Northern Virginia), continues to defend “the Clinton IRS in court.
“Will someone in the Bush Administration sit up, take notice, and stop the illegal politically-motivated IRS audits of Judicial Watch and other perceived adversaries of the discredited Clinton administration? Will there be an investigation into why these smoking gun documents were illegally withheld for nearly four years? Will IRS officials, such as Clinton-appointed Commissioner Charles Rossotti, be subject to criminal investigations? These are questions that Attorney General John Ashcroft must answer affirmatively if he is to uphold his oath to enforce the law, stated Judicial Watch Chairman and General Counsel Larry Klayman.
