Jury deciding if Company was unfair to foreign workers

FRESNO, Calif. (AP) -- Jurors in U.S. District Court will decide if a company weeded out Hispanic and Southeast Asian workers by offering a job skills test only in English.

Attorneys presented closing arguments on Tuesday in the nine-year-old case against NIBCO, an Indiana-based manufacturer of irrigation systems.

Workers' attorney William J. Smith argues that the test did not assess job skills fairly, and that managers knew workers spoke Spanish, Lao or Hmong.

The company's attorney says the lack of a common language is a barrier to communication, safety and productivity.

The 23 former workers are suing for lost wages and emotional distress

Imagine that! Potential employees in America being offered a skills assessment test in English!

If this is determined to be discriminatory against "foreign" workers, then how come it's not considered "discriminatory" when a company requires those seeking work in this country to speak spanish!!!

Let me make sure I got this right. Allegedly, it's discriminatory to require foreign workers to take a test in English, but perfectly ok to exclude Americans from a job because they do not speak spanish!

Just another example of political correctness gone horridly, horridly amuck in this country!

And what happens when they have to read detailed instructions on something? Do we have to accomodate 200 different languages?
