    Special Order 40 Prohibits Police From Questioning Immigration Status

    LOS ANGELES -- A proposal to go after gang members who are in the country illegally gained support Thursday from Los Angeles City Councilman Dennis Zine, who said he will seek to amend an LAPD policy that currently bars police officers from asking arrestees about their legal status.

    The councilman, who has spent almost 40 years with the Los Angeles Police Department -- in recent years as a reserve officer -- will introduce a motion Friday asking that Special Order 40 be amended to allow police officers to notify federal immigration officials of gang members who are in the United States illegally.

    Special Order 40 prohibits Los Angeles police officers from questioning or arresting suspects based solely on their immigration status. The order is intended to encourage illegal immigrants to report crimes and assist police.

    "The fact is that Special Order 40 allows Los Angeles police officers to inquire about immigration status if a crime has been committed, and reinforces the effort to deport an illegal immigrant if a crime has been committed," Zine said.

    "We can now take it one step further and say that if an individual is a known gang member and an illegal immigrant, that the LAPD has the responsibility and duty to turn the individual over to federal immigration officials."

    On Tuesday, the parents of Jamiel Shaw Jr., a Los Angeles High School football star who was shot and killed by a 19-year-old reputed gang member, urged city leaders to go after criminals who are also undocumented immigrants.

    Authorities believe Shaw's alleged killer, Pedro Espinoza, may have been in the country illegally. The 18th Street gang member has pleaded not guilty to murder.

    How would they know a gang member is an illegal alien, unless they ask? That they have allowed KNOWN gang members to terrorize the city and kill how many Americans is beyond me and they should be held responsible!

    this sound like blowing smoke, again. How can LAPD know if the suspect is an illegal immigrant. The way it works is that you find out by asking ICE. What is teh mechanism for LAPD to know inside its own workings if someone is illegal?

    The police have always been able to make inquiries into legal status if a crime has been committed! The LAPD(Bratton) and the illegal invader loving mayor seem to interpret special 40 as meaning they can never inquire into legal status, even if a crime has been committed. They will not ask about legal status even if the arrestee is a hardended gang banger with a rap sheet as long as a telephone book.

    Special 40 (need to do away with it) simply means you cannot walk up to a person with the intent of doing a legal status check as the sole reason for contact with that person.

    Once again, the law is not the problem. The problem is the mayor and his puppet police chief that do not have THE WILL to go after these illegal criminals.

    We know this is true because the illegal invader gang banging thug that murdered Jamel Shaw has just been released from custody! Had someone inquired as to his legal status, he would have been turned over to ICE for deportation upon release from custody.

    Talk radio host Kevin James interviewed Zine last night, on the motion Zine will supposedly introduce today. Zine said this will go to committee after it is seconded by Greg Smith, another LA city councilman. Zine said it will take much public pressure to get this through the Council.

    Kevin later spoke with LA mayoral candidate Walter Moore (author of Jamiel's law) about Zine's motion, and while both Kevin and Walter will support the motion for now, they expressed concerns about it. I believe both think Zine's motion, while a good start, is watered down and contains some ambiguous language.

    UPDATE: Councilman Dennis Zine will bring a motion to the Public Safety Commission tomorrow that calls for Federal Notification of Known Illegal Immigrant Gang Members. Call commission members Weiss, Parks, Smith and Reyes, and tell them to pass the motion before any more innocent people die!

    I was listening last nite, too...Populist. I agree with you that there was some ambiguous terminology...i.e. the ability to ask legal status if they were involved in a "gang suppression investigation". Kevin James was perplexed, too. What the heck is a "gang suppression investigation"?

    At any rate, I think that-Zine is well-intentioned, but he is fighting an uphill battle with that Gang of 15 in city council. My prediction is that they will use "stall" tactics until the election next year, and then they will come up with some sort of watered down version of SO40. We should never forget that these are the same people who conjured up the disgusting, anti-American "Declaration of Los Angeles" last year.

    This is a commendable effort, to be sure. But the problem is that no matter how much rewording is done, the fact of the matter is that the mayor and his reconquistas are calling all the shots and,as long as they are, nothing will be done. At least nothing will be done to illegal latino gang bangers.

    Something needs to be done to stop Villaraigosa, Nunez, and the rest of them running CA on behalf of the Mexican government.
