MCMINNVILLE, Ore. (AP) - A Yamhill County grand jury indictment says a 26-year-old man has admitted drinking beer before a crash on Mother's Day that killed a mother of seven.

Authorities say Leonel Zurita-Loeza of Portland had a blood alcohol content more than twice the legal limit.

They say he was on diversion from a DUI charge and the car he was using had an emergency spare rated for 50 mph driving.

He's charged with manslaughter and assault, among other counts. He's being held on $1 million bail.

Immigration authorities have placed him under a federal detainer because he is in the country illegally.

The crash killed 52-year-old Carma Smith of Dayton, a long-time rural mail carrier. She had just celebrated her 33rd wedding anniversary.

Actually, you'll all be pleased to learn (sarcasm intended here, of course), that not only was he given first class emergency care after the very bad collision that he caused, he was even Life-Flighted into one of the bigger hospitals in downtown Portland (about 25 miles away). That alone, is probably a $10k-$15k chopper ride. I wonder who is going to pay for that?
Not to mention... the rest of the hospital bill for the perp, his two buddies in the car, the victims of the other car affected, the funeral/car/misc. expenses imposed on this poor woman's family, the investigation costs of the local PD, the costs to put him in a cell and feed him 3 times a day, the court costs, etc. etc. etc. etc. etc. -

There is nothing so expensive as cheap labor.

Airborne - I have no sympathy for him either. Totally inexcusable.

Lars Larson, a local talk radio guy, and STALWART supporter of ENFORCEMENT, has been plugging this story locally here very well. Don't know if you watch Dobbs, but Lars was on today as one of the guest panelists.

Thanks for the update Phred. At least this tragic entirely preventable story is receiving some media attention in the N/W. As we all know, the OBL and MSM would just as soon have this and similar stories swept under the rug so they can continue their bombardment of us with sob stories about "hard working immigrants."

I do follow Lou Dobbs as much as I can, but it normally starts about the time I have to be at work...... this seems to be the norm for America .. we are being desensitized as if this is the way it is supposed to be

this poor family has lost it's matriarch to a drunk Illegal Alien.... it's time to get P.O.ed America ... it's time to start charging our corrupt politicians as an assessory to the crime

this is enough to take any man to his knee's ... I want to see the machismo come out if he is sent to prison for life or better yet, on death row.

Not ONE American Life is worth cheap imports or cheap labor that the Democrats want and the Republicans pander for

I am sitting here gritting my teeth on this one

Yep, agree with you Pop, Airborne. It was totally preventable and brings out the sheer rage in a lot of people.

I do hope, that one day the family of Mrs. Smith are able to find their way here. I think that would be good for all involved. Also, as a related - I know people in that line of work here in the area, and I'm sure the news is making the rounds in the last week or so. Plus, one thing that I noticed from an earlier story on this situation, is she was killed at approx. 3pm in the afternoon - this could have been a work day for her. I'll see if I can make some phone calls and get some action going amongst the locals here.

She was living or working in the town of Dayton, which is just up the road from where the 'accident' took place. Also, I haven't heard any word of this, but for everyone's benefit... the particular road this happened on is a major secondary link from the coastal areas into the [Willamette] valley. Most notably, it has a BIG Indian casino about 20 miles West of where the accident happened. Do you suppose it's possible the perp was over at the casino drinking with his buddies before he jumped in his car and left? (that's my hunch, but it's only a hunch).

Did Leonel Zurita-Loeza of Portland have a driver's license?

In Oregon is an illegal alien who had gotten a driver's license before the law went in effect, valid until it expires?

    Article undated:

Immigrant-rights groups rally on the steps of the Oregon State Capitol on Jan. 11, in Salem, Ore., to oppose legislation that would require proof of legal presence to get an Oregon driver's license, starting Monday.

More states to deny illegal migrants driver's licenses

    By Emily Bazar, USA TODAY
States that have been issuing driver's licenses to illegal immigrants are making U-turns.

Beginning Monday, illegal immigrants in Oregon no longer will be able to get driver's licenses. Last week, Michigan stopped issuing new licenses to all but citizens and legal permanent residents.

REVISED POLICY: Mich. to bar licenses to illegal aliens

Maryland announced this month that starting in 2010, it will require applicants to prove they're in the USA legally.

In four of the five remaining states that allow illegal immigrants to drive — Hawaii, Maine, New Mexico, Utah and Washington — there have been attempts to reverse course, according to the National Immigration Law Center (NILC). The exception: Hawaii.

"Oregon is one of the few states in the country that didn't have these ID requirements for driver's licenses," says Patty Wentz, spokeswoman for Gov. Ted Kulongoski. "That made us one of the weak links."

Kulongoski, a Democrat, directed the state's motor vehicle agency to require a valid Social Security number and other proof of identity. A legal resident who doesn't have a Social Security number can present other ID, such as a current visa.

Some officials who are changing policies cite a federal law that sets standards for licenses to deter fraud and terrorism, but political pressure also motivated the changes.

Last year, New York Gov. Eliot Spitzer, a Democrat, ignited a firestorm when he proposed letting illegal immigrants have licenses. He dropped the plan after protests from county officials, state and federal lawmakers and opponents of illegal immigration such as NumbersUSA.

"The whole New York debacle really scared a lot of policymakers," says the NILC's Tyler Moran. "People are folding before they're even forced to."

In Michigan, Secretary of State Terri Lynn Land now issues new licenses only to citizens and legal permanent residents. The state Legislature is considering her proposal to issue licenses to legal but temporary residents.

Martha Gonzalez-Cortes of Michigan's Office of Migrant Affairs says she's concerned that illegal immigrants will drive without licenses and insurance. "As the number of accidents involving uninsured drivers goes up, that will get passed along to the average consumer," she says.

In Maryland, Gov. Martin O'Malley, a Democrat, this month directed the transportation department to create a single driver's license that complies with the new federal law and rules out illegal immigrants. He dropped a plan for a two-tier system that would have allowed an illegal immigrant a license OK for driving but not for boarding planes or entering federal facilities.

"The governor felt we could not allow our state to become the only state on the East Coast to allow undocumented immigrants to get driver's licenses," spokesman Rick Abbruzzese says. "The governor did not want Maryland to become a magnet state for people trying to get driver's licenses."

Utah state Rep. Glenn Donnelson, a Republican, has tried for four years to stop illegal immigrants from getting driver "privilege cards," which allow them to drive legally.

Donnelson says his bill may have a better shot this year because of momentum in other states. "I think the citizens are a little upset because the federal government's not doing anything about this problem," he says.
