A Goodhue man was sentenced to 240 days in Goodhue County Jail Monday morning for molesting a girl who was 3 years old at the time.

Armando Medina Olmos, 26, also received a stayed 36-month prison sentence; if he completes all the conditions of his 25-year probation, he will not actually serve prison time.

Olmos was booked into Goodhue County Jail on July 9 and has been held since then. He pleaded guilty to one count of second-degree criminal sexual conduct Oct. 1.

According to a complaint filed in Goodhue County Court May 25, the girl’s mother found what appeared to be semen on the child’s sheets after she caught Olmos coming out of the girl’s room.

The girl told investigators that Olmos had touched her body with his penis and “got my bed wet.”

Lab testing showed that the substance on the sheets and the girl’s underwear was semen and that there was a high probability it belonged to Olmos.

In court Monday, both Assistant Goodhue County Attorney Erin Kuester and defense attorney John Gavin asked First District Judge Thomas Bibus to agree to the above sentence, which was outlined in a plea agreement.

“The plea agreement gives every person the opportunity to move forward and heal,” Kuester said.

As a result of a plea agreement, another second-degree criminal sexual conduct charge and a fifth-degree criminal sexual conduct charge were dismissed.

Olmos will receive credit for 155 days already served. As per Minnesota state statute, he will serve two-thirds of his sentence behind bars and the last third on supervised release. Olmos will hit the two-thirds mark of his sentence and be released late this week.

However, because Olmos does not have legal status in the United States, he will be turned over to Immigration and Customs Enforcement upon his release, Kuester said.
