    witness

An illegal alien is not a credible witness, they are criminals, and it’s a shame we let them in our court rooms for anything other then their prosecution.

there was a link to the video here on ALIPAC a while back that clearly showed that the agent WAS being threatened by the illegal with a rock, or something in his hand. The video showed the illegal winding up to release whatever it was in his hand and then Corbett shot him. The illegal was about 6 or 10 feet from him when the gun went off. Corbett had every right to defend himself and I'm just wondering if anyone has seen this video?

Border Patrol agent testifies he killed migrant in self-defense

    By Arthur H. Rotstein
    ASSOCIATED PRESS

    2:50 p.m. March 4, 2008

TUCSON, Ariz. – A U.S. Border Patrol agent on trial for the shooting death of an illegal immigrant from Mexico testified Tuesday that he fired in self-defense.
Agent Nicholas Corbett told jurors that he shot 22-year-old Francisco Javier Dominguez Rivera of Puebla because he was about to hit the agent in the head with a rock. He said he was facing Dominguez, holding him off with his left arm outstretched and handgun in his right hand pointed downward when he fired.

Corbett is more than a foot taller than Dominguez was.

Prosecutors contend that Dominguez was on his knees surrendering when he was shot.

In his closing arguments to jurors Tuesday afternoon, special prosecutor Grant Woods urged them to convict Corbett of the most serious of the charges he is facing, second-degree murder.

Woods said there was no threat to the agent but that he had his gun drawn and his finger inside the trigger guard. An unintended squeeze of the trigger caused his gun to fire, Woods said.

The actions amounted to a “grave indifferenceâ€

Jury Deliberations End in Border Patrol Agent's Trial
    March 5th, 2008 @ 5:44pm
    by Associated Press

TUCSON, Ariz. - Jurors deliberating the fate of a U.S. Border Patrol agent charged in the fatal shooting of an illegal immigrant from Mexico have recessed until Thursday.

The jurors worked nearly eight hours Wednesday toward trying to reach a verdict in the trial of agent Nicholas Corbett, who is charged with second-degree murder, negligent homicide and manslaughter.

Corbett testified that he shot 22-year-old Francisco Javier Dominguez Rivera in self-defense in January 2007. Prosecutors contended he shot without provocation.

Jurors can convict on only one count.

The jury panel sent out at least one note Wednesday but were turned down in a request to see partial or entire transcripts of trial testimony.

They also spent about a half-hour deliberating on Tuesday after lawyers on both sides completed closing arguments.

Wonder why they were turned down? Isn't this commonly done during deliberations?

I never saw the video but I did hear about it. This is a shame. Let's hope the good people of Arizona will rule justly.

This is where patriots have to protect one another....in jury trials. It only takes one juror to make a hung jury and no matter what judges say, jurors have a right to vote the way they see fit. Otherwise, why have a jury...just let the judge dictate or decide if he's going to instruct the jury on what they have to do. Bunk!! Ramos and Compean were railroaded and here we go again.

Jury Deadlocked in Border Agent's Trial
By ARTHUR H. ROTSTEIN – 8 hours ago

TUCSON, Ariz. (AP) — Jurors say they are deadlocked in the case of a U.S. Border Patrol agent charged with fatally shooting an illegal immigrant in Arizona near the Mexico border.

The jury in Nicholas Corbett's trial deliberated about 11 hours before telling the judge in a note Thursday morning that they are deadlocked. The judge has sent them back and told them to redouble their efforts to reach a verdict.

Corbett is charged with second-degree murder, manslaughter and negligent homicide in the 2007 death of 22-year-old Francisco Javier Dominguez Rivera of Puebla, Mexico.

Dominguez's brothers were crossing the border with him and have testified that he was going to his knees to surrender when Corbett shot him. Corbett has testified he shot in self-defense after Dominguez raised his arm to throw a rock.
