TRENTON – A man who's accused of sexually assaulting a young child claimed the 6-year-old, "had sex with him," when he was drunk one night, according to Mercer County prosecutors.

During a bail hearing Tuesday morning, prosecutors outlined the accusations against David Baten, 22, of Trenton, who is charged with sexually assaulting a 6-year-old girl and giving her genital warts, prosecutors said Friday.

Police began looking into Baten after the child's parents recently noticed she was bleeding and brought her to the hospital. A nurse at the hospital, who recognized the bleeding as a result of the STD, called the Division of Child Protection and Permanency (DCPP), prosecutors said. The DCPP then reached out to the police.

During the investigation, police discovered that Baten had contracted genital warts earlier in the year. The girl's mother confronted Baten, who told her that six months ago he came home drunk and tried to sexually assault the victim but couldn't, according to prosecutors.

Police continued to press Baten in interviews and eventually the 22-year-old admitted to the sexual assault, but claimed that the 6-year-old child had initiated the encounter when she, "climbed on top of him," while he was drunk and lying in bed, prosecutors said.

Baten is in the country illegally and is on an Immigration and Customs Enforcement (ICE) detainer, prosecutors said.

A judge maintained Baten's bail at $300,000 Tuesday.
