    NEB: Trial of Fremont law Delayed till April 2012

    Trial on Fremont law delayed


    It will be next year before the trial in the legal challenge of Fremont’s illegal immigration ordinance gets under way.

    A federal judge on Thursday rescheduled the trial for April 2012. It had been scheduled to start March 15.

    The voter-approved ordinance, which is on hold pending legal challenges, bans hiring and renting to illegal immigrants in Fremont.

    U.S. Magistrate Judge F.A. Gossett granted a request from the plaintiffs for more time to prepare for the non-jury trial, a lawyer involved in the case said.

    Kris Kobach, representing the City of Fremont, said the new trial date was not unexpected.

    “This is not at all unusual for a federal court to provide plaintiffs an extended period of time to look for facts that support their case,’’ Kobach said in a statement.

    The lawsuits challenging the ordinance were filed by the American Civil Liberties Union of Nebraska and other parties.

    The ordinance would require employers to use a federal online system to check whether a person is permitted to work in the United States

    It also would require people seeking to rent property in Fremont to apply for a $5 permit at City Hall.

    Gee, the ACLU is just filing suits without even knowing what legal standing they have to do so. Then april 2012? Sheesh. I sure hope the judge didn't put a hold on the law until then but I'm betting he probably did.

    OMAHA - A March trial in a legal fight over a Fremont ordinance that bars businesses from hiring and landlords from renting to illegal immigrants will be rescheduled.

    A federal judge has cancelled the March 15 non-jury trial in Omaha. Court records show a new date will be set during a meeting with attorneys later this month.

    The American Civil Liberties Union of Nebraska and the Mexican American Legal Defense & Educational Fund, also known as MALDEF, are challenging an ordinance that was approved by Fremont voters in June. The groups, whose lawsuits have been combined, argued that the ban is discriminatory and contrary to what is allowed by state law.

    Faced with expensive legal challenges, the city council suspended the ban until its legality is decided in court.

    That judge is coveringhis butt because he does not have the guts to make a ruling on it. He hopes some other judge will get a case similar and then base his ruling on it. Judicial buck passing. That or they want it to become a political thing where it will fall on election year and he hopes the law is withdrawn by political figures running for reelection.
