    Manasquan says it's powerless to do anything about day laborers

    MANASQUAN — With the borough's hands tied legally, the Borough Council said at its meeting tonight that it is up to local residents and businesses to help address the issue of day workers congregating within the municipality.

    "The borough has to admit that we are helpless, that there is nothing (we can do) until a higher level of government intervenes,'' said Councilman Michael Mangan, chairman of the Manasquan Committee on Day Workers, which was formed in May
    and presented its report to the council and the public at tonight's meeting at borough hall on Main Street.

    Mangan said the issue of undocumented day laborers must be dealt with at a federal level.

    Quoting his committee's report, copies of which are available through the borough clerk's office, he said: "The committee realizes, in the face of mountains of legal precedent, that the borough is paralyzed from acting on this matter in any official capacity. That being said, there is nothing preventing a private citizen from making a personal choice to abstain from hiring any worker who does not provide appropriate documentation or paying any contractor who hires such employees.''

    In its report, the committee also recommended that the Borough Council draft and pass resolutions urging the state Legislature and the United States Congress to act on the matter and provide a permanent and comprehensive solution to the
    problems of day workers and illegal immigration.

    Following the presentation of the report, committee member and borough resident Phil Tischio said, "Since there's nothing we can do, I think the true issue is the participation of the town, to deny ourselves the right to hire these people.''

    What kind of genius is Councilman Michael Mangan, chairman of the Manasquan Committee on Day Workers!

    He says "there is nothing preventing a private citizen from making a personal choice to abstain from hiring any worker who does not provide appropriate documentation"--states it's okay for a person not to hire an illegal immigrant. Wow...so glad to learn I don't have to hire.

    He says, "there is nothing preventing a private citizen from making a personal choice to abstain from....paying any contractor who hires such employees.'' These words say you don't have to pay a contractor who employs illegal immigrants.....hahahahaha Councilman Michael Mangan says I don't have to pay you for the work because you hire illegal immigrants. This is too good

    The committee also recommended that the Borough Council pass resolutions urging the state Legislature and Congress to act on the matter and provide a permanent and comprehensive solution to the problems of day workers and illegal immigration.     The committee, which also included Mayor George R. Dempsey, Councilman Jeffrey K. Lee, Police Chief Daniel Scimeca and code enforcement officer Neil Hamilton, wrote that geography, job availability and the number of rental properties in town all contribute to the day worker problem.

    While the report said the day workers' presence has negative aesthetic and economic effects for the borough, it noted the Police Department "has seen no increase in crime that can be directly attributed to this group of day workers nor does it believe them to be more or less of a safety risk than the population at large."

    Some residents at the meeting said the committee's report was not sufficient.

    "I don't mean this to be insulting, but I think this is unacceptable," Main Street resident Kim Chella told the mayor and council. "We don't know who these people (the day workers) are. It's about safety."

    Chella said some residents will not shop at Acme at Main Street and Taylor Avenue because many day workers gather there to wait for work.

    "I don't think it was even close to being good enough," Chella said of the report.

    It took these geniuses from May to January to come up with this report? What a waste of tax dollars.

    The borough is only 'helpless' because it wants to be and blames 'higher level of government' for its inaction. Their defense is akin to post WWII Nazi crime trials--"I was only following orders". No one is helpless nor is any government enitiy.
