OK: State immigration law challenged again in court
State immigration law challenged again in court

Documents: Read the lawsuit filed by Michael C. Thomas.
A lawsuit filed Thursday asks a Tulsa County judge to declare that a new state law dealing with illegal immigration is unconstitutional.
Plaintiff Michael C. Thomas, identified as a resident taxpayer of Tulsa County, seeks "to prevent an alleged wrongful expenditure of public funds by the State of Oklahoma and Tulsa County" for enforcement of an unconstitutional statute, according to the court filing.
The law -- commonly known as House Bill 1804 -- was written by state Rep. Randy Terrill, R-Moore, and denies illegal aliens access to certain government programs and pushes police to enforce federal immigration laws.
The court action lists as defendants Gov. Brad Henry, "who is charged with the responsibility of seeing that the laws of the state are faithfully and constitutionally executed," and the Tulsa County Board of Commissioners, the "elected public body obligated and responsible for the expenditure of public funds required in the enforcement of the extensive provisions incorporated" in the immigration law that took effect Nov. 1.
The filing also requests an injunction to prevent enforcement of provisions incorporated in House Bill 1804 until a court hearing is conducted.
The case is assigned to District Judge Jefferson Sellers. No hearing date is set.

The pro-illegals are Judge Shopping. It will be interesting to see if this Judge reverses the Federal Judge's ruling. That will prove the fact that the lobby is shopping for a sympathetic Judge..
