Border Patrol agents arrested a Guatemalan sex offender Thursday near Sullivan City.

Agents arrested Byron Estuardo Lucero, 34, a Guatemalan citizen — and moderate-risk sex offender registered with the Texas Department of Public Safety.

"Record checks revealed the Defendant was formally Deported/Excluded from the United States on December 7, 2011, through Houston, Texas," according to the federal criminal complaint against him.

Estuardo was convicted of sexual assault of a child on Sept. 23, 2009, according to Department of Public Safety records. A judge sentenced him to three years probation.

He's now charged with illegal re-entry.

Court records don't list an attorney for Estuardo, who couldn't be reached for comment.
