    Maryland prosecutors have dropped charges against two immigrant teens accused of raping and sodomizing a classmate in a high school bathroom.

    Montgomery County State's Attorney John McCarthy told a judge Friday that after an investigation, authorities are dropping rape and sex offense counts against 17-year-old Jose Montano, who was charged as an adult.

    He and 18-year-old Henry Sanchez-Milian were charged in the alleged assault on the girl at Rockville High School in March.

    McCarthy said at a news conference this morning that the same charges against Sanchez-Milian also are being dropped due to lack of evidence.

    'We have concluded that the facts in this case do not support the original charges filed in this matter,' he told reporters. 'Due to the lack of corroboration and substantial inconsistencies from the facts that we have obtained from multiple sources since the filing of the original charging document, the original charges cannot be sustained, and prosecution on those charges is untenable.'


    The pair were accused of sexually assaulting and sodozming a 14-year-old girl inside a men's room at Rockville High School in March

    The prosecutor said the case was closed following a through two-month investigation, which includes a review of medical, phone and computer records, school security videos, and interviews with witnesses, reported the Washington Post.

    Sanchez-Milian, who was living in the US illegally, now faces new charges of child pornography possession and distribution.

    Attorney Maria Mena says Montano also faces child pornography charges in juvenile court, which she called 'egregious.'

    The new criminal counts are stemming from explicit photos defense attorneys say the girl sent to Montano, which he then shared with Sanchez-Milian.

    Andrew Jezic, Sanchez-Milian's defenses lawyer, slammed the decision to charge his client with possession of child pornography as 'selective prosecution of elective promiscuity.'

    The rape case sparked national headlines after the White House called it an example of why President Donald Trump wants to crack down on illegal immigration.

    The pair were arrested on March 16 after the 14-year-old girl went to the police claiming that Montano and Sanchez-Milian took turns raping her inside a boys' bathroom after she rejected their sexual advances.

    According to court documents filed in the case at the time, the freshman knew only one of the teens, Montano, who allegedly asked her for a hug, then slapped her butt and asked her to walk with them.

    As the trio were passing by a boys' bathroom on the way to the gym, the 17-year-old Montano repeatedly asked the girl to have sex with him and his friend, and when she refused they allegedly forced her into the restroom.

    The probable cause document described the assault in extremely graphic detail, recounting how the alleged victim grabbed onto a sink to avoid being forced into a stall, but the two suspects shoved her inside.

    Once in the stall, the document stated that Montano allegedly opened the girl's top and 'pulled her breasts out to play with,' then unbuckled her pants and pulled them down.

    The two teenagers then allegedly proceeded to take turns holding down the young girl while forcing her to perform oral sex on them and raping her both vaginally and anally on the toilet multiple times while communicating with one another in Spanish.

    Throughout the ordeal, the document stated, the victim screamed out in pain and repeatedly told her friend Montano, and Sanchez-Milian to stop.

    After the attack, police said Sanchez-Milian covered the victim's head with his coat and led her out of the bathroom as Montano ordered her to be quiet.

    The freshman girl immediately reported the assault to school administrators and law enforcement officials were summoned to the scene to investigate.

    Montgomery County Public Schools has been besieged by hundreds of racist and xenophobic calls in the wake of the incident. In response, schools beefed up police presence in an attempt to reassure the anxious community.

    During a preliminary hearing in late March, Andrew Jezic, Sanchez-Milian's lawyer, told the court that the sexual encounter between his client and the girl was 'pre-planned' and consensual.

    Sanchez-Milian, who is from Guatemala, came to the US illegally in August and was encountered by a US Border Patrol agent in Texas, federal immigration officials said.

    He was eventually released to live with his father, Adolfo Sanchez-Reyes, 43, who was taken away by ICE agents in late March for illegally immigrating to Jessup, Maryland, from Guatemala.

    Immigration and Customs Enforcement won't report on Montano's immigration status as he is a minor.

    Montano arrived El Salvador about eight months ago to live with his relatives who are reportedly US citizens.

    I cannot begin to comprehend this. I blame Casa de Maryland for advancing EVERYTHING for illegals and screw legal citizens. I am truly sickened.

    I DO NOT condone violence for violence's sake but I won't be surprised to read that these 2 wind up dead somewhere. I believe somebody's Daddy will do the job the prosecutor's refused to do.

    Maryland is lost I'm beginning to believe. Baltimore DA is urging lowering charges to protect illegals and now this.

    Reporters Attempt to Smear White House Over Illegal Alien Rape Accusations

    Outraged reporters piled onto Principal Deputy Press Secretary Sarah Sanders Friday during a press conference, demanding to know why the White House had dared mention an alleged rape committed by illegal-alien suspects after initial charges were dropped.

    “I want to ask you about this case out of Maryland,” ABC News reporter Cecilia Vega began, and went on to say:

    "As you probably know, the prosecutors have dropped the rape charges against the two, undocumented teens [sic] accused of attacking that 14-year-old classmate. This White House has been—was vocal on that case from this podium. Sean Spicer said that ‘a big of the reason this president has made illegal immigration and crackdown such a big deed—deal, is because of tragedies like this.’"

    Vega then made a mock-concerned expression and asked: “Did this White House unfairly jump to conclusions in this case?”

    On Mar. 16, Maryland police arrested two illegal alien suspects, 18-year-old Guatemalan Henry E. Sanchez Milian and 17-year-old El Salvadoran Jose Montano, after staff at Rockville High School in Maryland reported an alleged rape of a 14-year-old freshman who claimed to a police detective she had been raped orally, anally, and vaginally simultaneously by the two suspects after being stripped naked and “bent over a toilet” in the boys’ bathroom. A forensic specialist found blood and bodily fluids in the bathroom after the alleged victim said she was raped.

    Prosecutors in the case, which sparked a national uproar, said on Friday they planned to drop the first-degree rape and sex offense charges, citing the “challenges corroborating events the girl described,” according to the Washington Post. The alleged victim had exchanged sexually-charged text messages and images with at least one of the alleged assailants beforehand. Sanchez Milian will likely face child pornography charges, however.

    White House press secretary Sean Spicer had expressed indignation at the alleged gang-rape of the 14-year-old freshman. Spicer said at the White House in late March:

    "This is a tragic event, and it is horrendous, and horrible, and disgusting what this young woman in Rockville went through. I can’t possibly imagine. Part of the reason the president has made illegal immigration and [a] crackdown such a big deal is because of tragedies like this. Part of the reason is the tragedy this young girl dealt with, had inflicted upon her, whatever the word is. This is why he’s passionate about this. Because people are victims of these crimes."

    But since prosecutors dropped some of the charges against the illegal-alien suspects—and have decided to pursue others—leftist reporters thought they had a “gotcha” moment against anyone concerned about illegal immigration.

    “Look, I think we’re always looking to protect the American people,” Sanders replied. “Sean was speaking about what he knew at the time. And certainly, I haven’t had a chance to dive into the latest on that, but we will, and we’ll get back to you.”

    “You wanna retract anything that—that the White House has said so far?” Vega said.

    “I’m not gonna retract anything without further information in front of me,” Sanders said.

    Bizarrely, another CBS reporter wanted to know if the White House regretted speaking about a national scandal that would never have happened had illegal immigration from Central America been stymied, not encouraged, during the Obama years.

    “Have you talked to Sean and does he have any regrets about what he said?” CBS News’s Chip Reid asked.

    “I have not talked to Sean,” Sanders said, adding he was on Navy duty.

    Another reporter asked if “there is a general danger that the White House, through its rhetoric, is animating too many people to jump to conclusions against immigrants [sic] and in the process, diminishing the entire immigrant community [sic], whether they’re law-abiding or not?”

    “Not at all,” Sanders said, adding, “The president has been incredibly outspoken against crime in any form, fashion—certainly from his joint address, to his speech last week on Holocaust Remembrance Day. Look, this is a law-and-order president. He’s focused on restoring law and order. We’ve seen a spike in crime rates, starting in 2015, across the board, not just in any particular sector. I think that’s why he campaigned and talked so much about needing to restore law and order in this country. It’s why he’s focused on securing our border—stopping drug trafficking, human trafficking. Those are things that have been a priority for him. And I think the reason is, is because he places such a high value on that. And I think to call into question his rhetoric, to be anything other than someone who has condemned hate and violence in all of its forms, is simply a complete misrepresentation. Not only of who the president is, but also what he’s said.”

    I think the media is missing the point. The point is two much older illegal aliens are in a class with a 14 year old having wild sex with her in the school bathroom. At her age of 14, this is statutory rape whether consensual or not. Yes, I realize the laws have been changed to make this voluntary non-criminal if the boys aren't 19 or something. Either way, this is trash in our schools, totally unacceptable, completely disgusting, and wouldn't have happened if the males hadn't been in our country to begin with.

    The White House needs to continue to speak out against sex and illegal aliens in our school system.

    And you also don't know if there's some politics and wacky business going on in the DA's office. The police were absolutely confident.

    Illegal Aliens in Maryland HS Bathroom Sex Case Face Child Porn Charges

    Prosecutors in the “sanctuary state” of Maryland are dropping sexual offense charges against the illegal aliens accused of sexually assaulting a 14-year-old girl in a high school bathroom. The Rockville High School freshmen now face charges of distribution of child pornography.
    Montgomery County State’s Attorney John McCarthy told reporters “The facts no longer support the original charges filed,” the Washington Post reported. Prosecutors are now focusing their efforts on allegations of child pornography distribution after police found images of the victim on both suspects’ cell phones.

    Defense attorneys appeared to admit to the crime, telling the Washington, D.C. newspaper the girl willingly shared the images with one of the defendants. The images were then passed along to the other, they said.

    Henry Sanchez Milian’s attorney, Andrew Jezic, attempted to downplay the potential new charges saying, “it is hardly uncommon behavior for teenagers.” Defendant Jose Montano’s attorney, Maria Mena, appeared to deflect to her 17-year-old client’s co-defendant, saying the child pornography charges are made to go after adults, the Washington Post reported. Sanchez Milian 18-years old and legally an adult.

    The national public outcry after the alleged oral, vaginal, and anal rape became public in March was called “racist” and “xenophobic” by Montgomery County Public School Superintendent Dr. Jack Smith.

    If convicted, Sanchez Milan could face a sentence of five years in prison for child porn distribution charges. The younger Montano could face up to 10 years in prison for possession and distribution of pornography.

    Lawmakers in various states have been debating how to deal with the issue of teenagers sexting photos of their underage classmates, Breitbart News reported.

    In the lead up to filing sexual assault charges, law enforcement investigators reported the young teen said she cried out in pain and begged them to stop. A forensic investigator found blood and bodily fluids in the boys’ bathroom.

    Sanchez-Milan’s attorney countered that the young girl “actively planned a sexual encounter,” and a school video showed the girl and the 17-year-old accused teen walking into the bathroom together.

    Director of Policy Jessica Vaughan of the Center for Immigration Studies (CIS) told Breitbart News’ Katie McHugh, “The only reason the older youth, Sanchez Milian, was in the country at all was because of the Obama administration’s catch and release policies that allowed him to be resettled in Maryland (with the support of taxpayers), with few questions asked.”

    “Few groups of illegal immigrants have left such a violent mark in our community as these so-called unaccompanied minors—they are almost like modern day Marielitos (the Cuban inmates released by Fidel Castro decades ago),” she added. “Dozens have been arrested for violent crimes in Maryland, New York, Massachusetts, Virginia, and Texas.”

    Eighteen-year-old Henry Sanchez Milian, an El Salvadorian national, and 17-year-old Jose Montano from Guatemala were enrolled as freshmen at the high school.

    As reported by Breitbart News:

    The 1982 Supreme Court Case Plyler v. Doe forbids public schools from withholding taxpayer funding from illegal aliens, allowing them to enroll in schools meant to educate citizens’ children. As Breitbart News has reported, illegal aliens and their children are entitled to U.S. taxpayer-funded educations in spite of breaking many U.S. laws. American communities are forced to divert nearly $60 billion in funding each year from their own children to illegals, foreign-born students, refugees, and U.S.-born children of illegals granted citizenship by a footnote in the 5-4 Doe ruling.

    Milian was encountered by border patrol agents in the Rio Grande Valley in Texas in August 2016 before the alleged rape on March 16, 2017. He was turned over to the custody of his father. The 18-year-old had a “pending alien removal” case against him, but he was nevertheless allowed to enroll at Rockville High School.

    U.S. Immigration and Customs Enforcement (ICE) officers detained Henry Sanchez’ father, 43-year-old Adolfo Sanchez-Reyes, after determining the Guatemalan to be an illegal alien, reported Breitbart News on March 27. Sanchez-Reyes is being held at the Howard County Detention Center.

    Breitbart News reported in 2014 that Montgomery County had been one of the “’most prominent’ sanctuary cities in the country.”

    On March 27, U.S. Attorney General Jeff Sessions urged the state of Maryland to abandon any plans to make Maryland a so-called “sanctuary state.” On March 21, the largely Democrat Maryland House of Delegates approved the Maryland Law Enforcement and Trust Act which would prevent police officers from asking a suspect about their immigration status. It would prevent police officers from giving illegal aliens to federal authorities unless “required by federal law.” Officers would also have to get a warrant before complying with an ICE detainer request. As reported by Breitbart News, Maryland’s Republican Governor Larry Hogan threatened to veto the bill.

    On Friday, ICE confirmed they are seeking to deport Sanchez Milan to Guatemala, reported the Washington Post. Even though they do not have him in federal custody, ICE has issued a detainer. Montgomery County officials confirmed they will honor the ICE detainer because of the child pornography distribution charges.

    In the United States a 14-year-old child cannot legally consent to sex.

    The legal age of consent in Mexico is 12.

    Im not sure what it is Guatemala where these illegals are from, but it probably would not matter because very few sex assault laws are ever enforced in Mexico and Guatemala.
