Rape charge dropped against man, 20, but deportation begins

Rape charges against a 20-year-old Golden Gate Estates man jailed since July have been dropped after his teenage accuser’s credibility was called into question during interviews with lawyers handling the case.

Assistant State Attorney Deborah Schwartz filed a notice of nolle prosequi this past week before Circuit Judge Frank Baker, declining to prosecute Diego Gaytan on a charge of lewd and lascivous battery. Gaytan, who lived at 8205 Sanctuary Road, No. 2, faced up to 15 years in prison on the second-degree felony.
