If Congress hasn't passed DACA legislation before SCOTUS rules on these lower court blocks, it may work against them. If SCOTUS rules that DACA is unconstitutional, with public sentiment against amnesty they would be hard-pressed to vote for it. So they need to make it legal before the court rules against it.
