Two Mexican nationals deported after pleading guilty in sex assault

Two illegal immigrants accused of kidnapping and raping a Grand Junction woman on Colorado National Monument pleaded guilty this week to unlawful sexual contact.
Reynaldo Tuyub, 21, and Lorenzo Varguez, 28, both Mexican nationals, and another unidentified man kidnapped the woman in August 2004, drove her up on the monument and sexually assaulted her before leaving her on the side of the road, Mesa County Sheriff’s Investigator Steve King said.
Some of the men met the woman at a bar earlier in the night, and Tuyub called her on her cell phone and offered her a ride home, according to court records.
Charges against another man, Carlos Soberanis, 34, were dismissed after he admitted to driving the van but denied participating in the rape.
“My feeling is he (Soberanis) really did not know what was going on,� King said. “He was deported right after they decided they were not going to charge him.�
Tuyub and Varguez were convicted of a class one misdemeanor and deported after having served 415 days in jail since their arrest, King said.
“Under the new Homeland Security Act and as a way of dealing with crimes committed by illegal aliens, by pleading guilty to that, it puts both of those people in a situation that if they attempt to come back in the U.S. illegally, they would be prosecuted and serve a 10-year mandatory sentence in a federal prison,� King said. “They are also registered sex offenders in the U.S. If caught entering again, that would void their plea agreement and they could look at possibly up to five years in state prison. So, they could be looking at 15 years, 10 of those mandatory.�
King said the victim was pleased with the outcome of the case, “both with the fact they pleaded guilty and they were being deported. From a victim’s standpoint, the last thing you want to do is go to trial on a sexual assault. It just brings up those very hard memories and feelings.�
King said he is satisfied justice was served.
