A Federal Way man was charged with the lesser form of manslaughter Friday in the death of his 7-month-old son, who fell into a backyard fire pit and burned to death.
The King County Prosecutor’s Office charged Alberto Rios, 38, with second-degree manslaughter, which carries a sentence ranging from 21 months to 27 months in jail.

A sentence for first-degree manslaughter could run about six years longer, ranging from 78 to 102 months.

Federal Way police arrested Rios on Tuesday on suspicion of first-degree manslaughter. But prosecutors didn’t feel they had enough grounds to press forward with the more severe charge, said spokesman Dan Donohoe.

Rios had been drinking and went to sleep last Saturday night on a bench, his son at his chest within a few feet of a burning fire pit, prosecutors say. He awoke and discovered the baby, Diego Rios-Santana, was gone.

Rios then found the baby lying face-up in the fire pit, burned over his entire body, court documents state.

Police accepted the decision of King County prosecutors to file the lesser charge.
