Senators prepare bill to block DOJ lawsuits against states

WASHINGTON -- Sen. Jeff Sessions and two other GOP senators want to prevent the U.S. Justice Department from suing states that pass their own immigration laws, including Alabama.

"The Justice Department needs to stop going after states that are taking steps in harmony with federal laws to see that our immigration laws actually are enforced and to help end the lawlessness," Sessions said in a press release today.
Along with Sens. Jim DeMint of South Carolina and David Vitter of Louisiana, Sessions is preparing legislation to block DOJ lawsuits like the one now pending against Alabama. The Justice Department is arguing that the enforcement of federal immigration laws is a federal responsibility and state laws interfere.
DeMint tried to pass a similar amendment last year to block the department's lawsuit against Arizona, but it failed a vote in the Senate. Sessions and Sen. Richard Shelby, R-Ala., voted for DeMint's amendment to block the lawsuit.
Sessions also this week asked a different federal agency to intervene against a local immigration policy approved by Cook County, Ill. That county is refusing to detain certain prisoners for extra time at the request of federal immigration authorities.
Sessions on Wednesday said he was asking that the federal government "consider taking action against Cook County and other local jurisdictions that purposefully and deliberately undermine the laws of the United States and offer sanctuary to illegal aliens who have broken our laws by entering the country illegally."

Likely that there will be enough Democrats senators who would filibuster this. Even adding blue dogs to Republicans it would have an uphill battle. Our only hope is that a greater number of liberal Democrat senators can be replaced with either Republicans or blue dogs.

DeMint, Vitter, Sessions push bill to ban immigration reform lawsuits

The State Column | Staff | Friday, November 04, 2011

Today, U.S. Senators Jim DeMint (R-South Carolina), David Vitter (R-Louisiana) and Jeff Sessions (R-Alabama) announced they will soon offer legislation to prohibit President Obama’s administration, including the Department of Justice (DOJ) and other agencies, from participating in lawsuits against South Carolina, Alabama and Arizona over recently passed immigration laws.

Senator DeMint said, “It’s absurd that the Obama Administration, which has failed to enforce the nation’s immigration laws, is now stopping South Carolina, Alabama and Arizona from taking commonsense steps to protect citizens and uphold the law. President Obama has failed to build the southern border fence mandated by Congress. He’s also failed to control the northern border, allowing the Border Patrol to stop conducting routine checks at bus stops and train stations for illegal immigrants who could be smugglers or terrorists. South Carolina has a duty uphold the law and to protect our citizens from criminals who are in the country illegally.â€

illegals must not be in this country

This is what we need and we have to vote all the dems out in 2012. They are destroying our country with illegal aliens. The dems are the only ones who support illegal immigration. WEll some Republicans as well. So I welcome this and let's work to vote Obama out in 2012. He is so inept and he supports illegal immigration. We do not. So Obama has to go once and for all.

If we can get a Republican President and move the Senate into Republican control, all of this will change. People are saying that Mitt Romney doesn't have a charismatic personality. The personality of the executive in the White House doesn't matter very much when you have control in the other branches. Romney would restrain some of the more hard right elements within the GOP. If the GOP gets control, or comes close to it, I would rather see balance than a lopsided vision that gets booted out during the next election cycles. If it looks like the far right elements are ascending to control I think this would trigger intense opposition in the liberal media, just as confidence in Obama's far left agenda is increasingly challenged.
