The former Subway employee who put cameras in the eatery’s Noroton Heights bathroom was sentenced to three years in prison, with two years suspended. Marco Dias, 22, pleaded guilty to voyeurism after the July incident, which came into light after a truck driver spotted the tiny camera placed under the sink.

Dias, a Brazil citizen, was in the country illegally after his visa expired, according to Immigration and Customs Enforcement. Dias was hired after his visa expired, yet Subway faced no penalties. Subway’s public relations manager, Kevin Kane, said all Subway restaurants are responsible for their own hiring practices.

“We do not condone the alleged behavior and can assure our customers that this is not the business practice used by Subway franchisees,” Kane said.

Dias was working part time, a Subway manager said, or roughly 10 hours per week, and was hired by a manager who is no longer at the store.

Deportation proceedings are in the works, but it is not guaranteed that he will be deported, noted Ross Feinstein, a spokesman for Immigration and Customs Enforcement, or ICE.

“Once local charges are fully adjudicated, he will be turned over to ICE and placed in removal proceedings,” Feinstein stated in an email. Deportation requires cooperation with Dias’ native country.

Dias also was also placed on probation for three years, according to court records.
