'TEQUILA PARTY' ASKS HOLDER TO PROSECUTE TEA PARTY FOR MURRIETA 'TERRORISM'

'TEQUILA PARTY' ASKS HOLDER TO PROSECUTE TEA PARTY FOR MURRIETA 'TERRORISM'

    by JOEL B. POLLAK 7 Jul 2014, 11:33 AM PDT 916POST A COMMENT

The "Tequila Party," a Latino group formed in opposition to the Tea Party, wrote to U.S. Attorney General Eric Holder and FBI Director James Comey on Monday to request that the Tea Party and several officials be investigated for their role in protesting and blocking the transfer of illegal aliens captured in Texas to Murrieta, California. The protests on July 1 turned back three busloads of aliens, though more are scheduled to arrive.

In their letter--signed by California attorney Ruben Salazar, pro-amnesty activist Dee Dee Garcia Blase, and Nebraska attorney Shirl Mora James--the group, writing on the letterhead of a new organization called "Somos Independents," called on Holder and Comey to launch an "outside investigation" of Murrieta city councilwoman Diana Serafin; U.S. Customs and Border Patrol agents Steven Golda and Gabe Pacheo; Murrieta mayor Alan Long, protest leader Patrice Lynes; the Murrieta Police Department, and local resident Joseph Culberson.

In addition, the signatories accuse Tea Party activists in Murrieta of being "homeland domestic terrorists (masquerading as patriots)," and allege that they were "were obstructing federal law enforcement from performing their jobs and terrorizing small refugee immigrant children from Central America with racial slurs."

Update: Blase responded to a request by Breitbart News for further comment. In response to a question about whether the activists expected the Department of Justice to respond to the request, Blase said:

I believe the DOJ will respond to all written formal requests of concern regarding Civil Rights issues. Please recall when Sheriff Joe Arpaio was investigated due to public outcry, and when Thomas E. Perez, assistant attorney general at the Department's Civil Rights Division said at a news conference: “At its core, this is an abuse-of-power case involving a sheriff and sheriff’s office that disregarded the Constitution, ignored sound police practices, compromised public safety and did not hesitate to retaliate against his perceived critics."
Asked about the First Amendment rights of Tea Party protestors and other demonstrators, Blase said:

Per California Lawyer via Ruben Salazar, here are some Constitutional principles to consider from the Supreme Court which limit our 1st Amendment rights:
    1) Supreme Court in Brandenburg v. Ohio enunciated the "imminent lawless action doctrine," and held that speech is not protected by the 1st Amendment if the speaker intends to incite a violation of the law that is both imminent and likely. And, under California Penal Code Section 404.6, it is a state crime to engage in the mere urging of others to engage in acts of force or violence. And under Federal law, Title 18 USC Sec 249 prohibits hate crimes. Title 18 USC Sec 241 prohibits conspiracy against Civil Rights. Title 18 USC Sec 242 prohibits deprivation of rights under color of law.
    2) Under Dennis v. US held that a State may forbid or proscribe advocacy of the use of force or violence where such advocacy is directed to inciting or producing imminent lawless action and is likely to incite or produce such action.
The "Masterminds of Murrieta" appears to have engaged in advocacy to use force or of law violation in order to incite or produce a riot.

In addition to these principles, the 1st amendment does not protect conduct, it protects speech only and it appears there were some individuals who were engaged in potential criminal conspiracy to violate federal and state laws.

Furthermore, we would like for DOJ and the FBI to determine who made the decision to block the bus since Mayor Alan Long admitted several protesters were from out of town--allegedly from FAIR or Numbers USA. This protest was highly organized. Did these out of town Tea Party protesters potentially violate Title 18 USC section 241, conspiracy against Civil Rights?
The goal in our letter is to facilitate an investigation.

I wonder which one of Holder's DOJ attorneys helped Rueben write the complaint. The problem is: The TEA PARTY didn't organize anything in Murrieta, the citizens did.

'Tequila Party' Seeks Prosecution of Tea Party for Murrieta 'Terrorism'

'Tequila Party' Seeks Prosecution of Tea Party for Murrieta 'Terrorism'

MURRIETA, CA - JULY 04: Protesters who oppose arrivals of buses carrying largely women and children undocumented migrants for processing at the Murrieta Border Patrol Station yell at counter-demonstrators on July 4, 2014 in Murrieta, California. Earlier this week, protesters in the city turned away buses carrying about 140 immigrants that had been apprehended in Texas and flown to California for processing as Texas deals with an influx of immigrants. Federal officials estimate more than 50,000 minors, mostly from Central America, have been caught crossing the border since October 2013. (Photo by David McNew/Getty Images) (Photo : Getty)

A pro-immigration group calling themselves the "Tequila Party" sent an official request to U.S. Attorney General Eric Holder and the FBI's Director James Comey on Monday asking them to investigate several Tea Party members for taking part in the demonstrations which prevented the transfer of undocumented immigrants from Texas to Murrieta, California.

Last Friday, anti-immigration demonstrators blocked three buses bringing immigrants to the U.S Border Patrol facility there, prompting officials to place plans for further buses on hold.

    According to Breitbart News
, the Tequila Party sent a letter to Holder and Comey requesting that they begin an "outside investigation" scrutinizing Murrieta councilwoman Diana Serafin; Steven Golda and Gabe Pacheo (two U.S. Customs and Border Patrol agents); Murrieta mayor Alan Long, protest organizer Patrice Lynes, the Murrieta Police Department, and Murrieta resident Joseph Culberson.

The letter's signatories--including California attorney Ruben Salazar, pro-amnesty activist Dee Dee Garcia Blase, and Nebraska attorney Shirl Mora James--are accusing Tea Party protesters in Murrieta of being "homeland domestic terrorists," and claim that protesters "were obstructing federal law enforcement from performing their jobs" as well as "terrorizing small refugee immigrant children from Central America with racial slurs."

When asked by Breitbart News about whether the Tea Party protestors should be protected under First Amendment rights, Blase replied:

Per California Lawyer via Ruben Salazar, here are some Constitutional principles to consider from the Supreme Court which limit our 1st Amendment rights:

    1. Supreme Court in Brandenburg v. Ohio enunciated the "imminent lawless action doctrine," and held that speech is not protected by the 1st Amendment if the speaker intends to incite a violation of the law that is both imminent and likely. Protesters are currently still awaiting the arrival of more buses, though officials claim no further buses are expected at this time.

    What is the 'Tequila Party'?
Some Hispanic Democratic leaders want to follow the Tea Party's example and remove themselves from their party's fold

By The Week Staff | December 1, 2010

The Tequila Party could help highlight the priorities of Hispanic voters, but some are calling the effort "racist."

Hispanic leaders in Nevada and elsewhere are reportedly considering severing their ties to the Democratic Party and forming an independent, grassroots group called the "Tequila Party." The idea, according to proponents, is to tap into the rising voting power of Hispanics in order to push for immigration reform and other legislation that Democrats have failed to deliver. Here's a quick guide:

    Why the Tequila Party?
The name is a direct nod to the Tea Party, which provided the inspiration, but with a Mexican twist. The idea is not to follow the politics of the Tea Party, which was born out of frustration over increased government spending. But would-be Tequila Party supporters want to mimic the Tea Party's success in spotlighting issues they believe to be neglected, like immigration and education reform, in the way Tea Partiers persuaded Republicans to make budget cuts a priority.

    Is this a smart move?
That depends on whom you ask. With Hispanics becoming a major force in politics, some activists think the aftermath of the midterms is a perfect time to demand a louder voice in Washington. Robert de Posada, a former GOP operative, calls it a "great concept" for Latinos who think Democrats are taking their "blind support" for granted. "If you are perceived as someone who will never vote for a Republican," he says, "then you're screwed." Other commentators think the only people it will help are Republicans. Pressuring Democrats to grant illegal immigrants amnesty, says Allahpundit at Hot Air, "would help the GOP a bunch."

Would liberal Hispanics really abandon Democrats?
Probably not, say some activists. But the Tea Party's relationship with the GOP could serve as an example. The Tea Party started out as a loose protest movement, but in the midterm campaigns it turned into a source of energy and money for fiscally conservative Republicans. Proponents of the Tequila Party say Latino voters demonstrated their power in Nevada by putting Senate Democratic leader Harry Reid over the top in a close race against Tea Party favorite Sharron Angle. As one Democratic operative said, "This is the time to move forward and get something committed other than talk."

Will the Tequila Party ever really exist?
That is not clear. The idea has received international attention, with some calling the effort "racist," while others "cringed at the name." But activists in Nevada and other states with large Hispanic populations praised the idea. "I don't know if it's going to happen, but there's talk," Fernando Romero, president of Nevada's nonpartisan Hispanics in Politics, told the Las Vegas Sun. Frank Sharry of the pro-immigration reform group America's Voice, says the Tequila Party will probably never get off the ground, but "I do think Democrats should worry because the arguments for the Tequila party are persuasive to me," he says. The frustration the group speaks to "is understandable."
