Prosecutors will seek the death penalty against an illegal immigrant from Mexico who is accused of killing a man in Arizona.

Demetrio Acosta-Uribe, 43, faces a first-degree murder charge in the May 26 death of Ivan Rosado-Santos, who was found shot to death in the yard of a home in west Phoenix.

Authorities believe Rosado-Santos, who had been bound and whose head was covered in plastic wrap, was shot as he tried to escape from Acosta-Uribe.

Two other men was similarly restrained and survived the incident.

Acosta-Uribe was charged with attempted first-degree murder, kidnapping, possession of marijuana for sale and misconduct involving weapons. He pleaded not guilty to the charges.

A review of Acosta-Uribe's case file didn't turn up a name for a lawyer who would be representing him or where in Mexico he came from.

Maricopa County Attorney Andrew Thomas said Acosta-Uribe had been deported by immigration authorities on five occasions.

"The federal government's continuing failure to control our borders has made us vulnerable to the worst kinds of violence," Thomas said.
