    I absolutely agree. One should be able to prove who they are and if they are here legally. 90 days is more than enough time to do so.

    Also what about the harm being done to Americans whose ids are being stolen? How come no one is ever concerned about them? More people are concerned about the lawbreakers than the American victims.

    It looks like a case can be made for this judge to have recused himself from involvement in this case right from the start.

    According to USC Title 28 Sec. 455 "disqualification of justice, judge, or magistrate judge" provides that a federal judge "shall disqualify himself in any proceeding in which his impartiality might reasonably be questioned"

    The same Section also provides that a judge be disqualified from any proceeding if, among other reasons, "the judge or a member of his immediate family has a financial interest in the outcome of the proceeding"

    Basically, this guy should never have been involved in this case, and imagine that.....he didn't even have the ethics to recuse himself!!! He needs a plaque on his bench which reads "I have no ethics. So what?"

    If the government is serious about enforcement, and regaining credibility with the American people, they will do whatever is necessary to put a stop to what is happening here.

    We the People just may have to start hammering away at these judges too.

    This further proves the Amnesty Bill's business enforcement provision was just a sham to get citizens to allow 20 to 30 million Illegals to become citizens.

    I hope amnesty fence sitters are paying close attention to this attempt by business to by pass our laws so they can continue their practice of paying low unsustainable wages which must be supplemented by Tax Payers through Federal Welfare Programs so business can satisfy their greed.

    You're correct USPatriot. The amnesty bill's enforcement provision was a sham, as is this latest alleged "crackdown" by Homeland Security and ICE -- even without the no-match letters AND even if the no match letters are ultimately allowed to go out. A few belated raids against a few employers, plus 70 miles of wimpy fencing (with even this in question) does NOT cut it by far. This is why we must agree to NO amnesty, "pathways" etc. whatsoever.

    The big challenge is cutting through the media filter, getting people involved, and changing the paradigm from one of appeasement to business/ethnic lobbies for illegal immigration TO one of illegal immigration is unacceptable for many valid reasons and will not be tolerated anymore, and woe to the politician who ignores the will of the people. That's why I am glad there are groups like ALIPAC, NumbersUSA etc.

    Chertoff is fignting hard to get those letter sent out and we need to let him know he have our support and encourgement.
    A lot is right on the letter being sent out. He said he would appeal if barred.
    This is big toward getting Illegals out of the workplace.

    NO JOB, NO WORK. GO HOME. DON'T COME.

    Identity theft is a state crime as well as a federal crime. It is not exclusively an immigration violation and we do not have to wait for the feds to prosecute it.


    Section 13A-8-192
    Identity theft.
    (a) A person commits the crime of identity theft if, without the authorization, consent, or permission of the victim, and with the intent to defraud for his or her own benefit or the benefit of a third person, he or she does any of the following:

    (1) Obtains, records, or accesses identifying information that would assist in accessing financial resources, obtaining identification documents, or obtaining benefits of the victim.

    (2) Obtains goods or services through the use of identifying information of the victim.

    (3) Obtains identification documents in the victim's name.

    (b) Identity theft in which there is a financial loss of greater than five hundred dollars ($500) or the defendant has previously been convicted of identity theft constitutes identity theft in the first degree. Identity theft in the first degree is a Class C felony.

    (c) Identity theft in which the defendant has not previously been convicted of identity theft and there is no financial loss or the financial loss is five hundred dollars ($500) or less constitutes identity theft in the second degree. Identity theft in the second degree is a Class A misdemeanor.

    (d) This section shall not apply when a person obtains the identity of another person to misrepresent his or her age for the sole purpose of obtaining alcoholic beverages, tobacco, or another privilege denied to minors.

    (a) A person commits the crime of trafficking in stolen identities when, without the authorization, consent, or permission of the victim, he or she manufactures, sells, transfers, purchases, or possesses, with intent to manufacture, sell, transfer, or purchase, identification documents or identifying information for the purpose of committing identity theft.

    (b) Possession of five or more identification documents of the same person, or possession of identifying information of five or more separate persons, without the authorization, consent, or permission of the person or persons, shall create an inference that the identities are possessed with intent to manufacture, sell, transfer, or purchase identification documents or identifying information for the purpose of committing identity theft.

    (c) Trafficking in stolen identities is a Class B felony.
