Interesting: They talked about taking their communications "off plan", in other words using non-trackable communications so they could continue their criminal enterprise without their activities being trackable.

DOJ Official Has Shocking Proof IRS Lied About Losing Emails

In the wake of the IRS claiming that they lost the emails of Lois Lerner from 2009-2011, a Department of Justice lawyer has come out and called the claim that a computer crash would cause it “laughable.”
The lawyer wished to remain anonymous, but they contacted the PowerlineBlog to set the record straight on the insanity coming from the Obama administration.
They wrote:
“I’m a DOJ lawyer, so you obviously cannot use my name or any identifying information. But the idea that a “hard drive crash” somehow destroyed all of Ms. Lerner’s intra-government email correspondence during the period in question [2009-2011] is laughable. Government email servers are backed up every night. So if she actually had a hard drive fail, her emails would be recoverable from the backup. If the backup was somehow also compromised, then we are talking about a conspiracy.
Keep up the good work.”
He even went further in his postscript:
“I’m serious about your keeping any identifying information out of the media. Things are very, very bad.”
As this unfolds we’re sure to see more shocking revelations develop from the most corrupt administration in history. It’s only a matter of time before something takes them down, the question is if Republicans will have the spine to act or not.

Lois Lerner's Blackberry may hold smoking gun

No hard drive crash could prevent the release of the email revealing Lois Lerner’s attempt to persecute Senator Chuck Grassley for receiving an invitation because it was sent from her Blackberry (hat tip: Ed Driscoll). This immediately raises the question of what other emails may have been routed through her Blackberry.

You may recall that just a couple of days ago, IRS commissioner John Koskinen declared that he didn’t know whether or not she had a Blackberry. That convenient obfuscation is no longer operative.

Let’s see what kind of accident Lois will come up with to explain the sudden disappearance or smashing of her Blackberry.

Congressman Files Motion to Arrest Former IRS Director Lois Lerner

On Thursday, July 10th, Congressman Steve Stockman has filed a motion that directs the Sergeant at Arms to arrest Lois Lerner on charges of contempt, embodied by her refusal to provide information related to the investigation of the IRS’ targeting of conservative non-profit organizations while she was acting director of the Exempt Organizations Unit.
Stockman, stating that“the Obama administration will not prosecute the Obama administration,” holds the view that the House holds the responsibility to bring the Obama administration to a position of accountability for “illegal” activities. This resolution, H. Res 664, would direct the authority of Congress to place Lerner in D.C. jail, where she would retain her legal right to counsel.

Just as an ordinary citizen can be found by a judge to be held in contempt of court, a government official, or anyone participating in an active Congressional investigation, can be held in contempt of Congress. The Sergeant at Arms, a position currently held by Andrew B. Willison, holds the responsibility of enforcing Congressional laws, as well as other duties such as providing security for Senate buildings, as well as Senate computers and technology support services. The Sergeant at Arms holds the authority to arrest anyone that breaks the rules of the Congress, including the President of the United States.
Found on the Congressman’s website, a more detailed look at the directives of H.Res 664 can be understood:
“Now, therefore, be it resolved, That the Speaker issue his warrant, directed to the Sergeant-at-Arms, or his deputy, commanding him to arrest and take into custody forthwith, wherever to be found, the body of Lois G. Lerner, and bring her to the bar of the House without delay to answer to the charge of contempt of its authority, breach of its privileges, and gross and wanton insult to the integrity of its proceedings, and in the meantime keep the body of Lerner in his custody in the common jail of the District of Columbia, subject to the further order of the House. While in custody, Lerner shall enjoy no special privileges beyond those extended to her fellow inmates, shall not access any computer or telephone, and shall not be visited by anyone other than her counsel, clergy, physician, or family.”
Lerner’s initial declaration of intention to observe her 5th amendment rights, floundering on a congressional subpoena, followed more recently by the “loss” of email correspondences have added to the already-corroded perception of the U.S. Government by it’s citizens. Congressman Stockman feels that a democratic Senate will not take action to prosecute the illegalities of a democratically-aligned political action, therefore calling on a Republican House to take responsibility to initiate such a charge of accountability. The division of our country, along with it’s leaders, can be found; exemplified, in the language of this resolution:
“Whereas the executive and judicial branches’ prolonged and dawdling failure to prosecute Attorney General Holder’s insolent contempt of the 112th Congress strongly suggests that a like proceeding against contemnor Lerner would be similarly futile”
There surely was a time in our country’s history where such accusations of misconduct by government officials would have ended in some form of prosecution, be it in the direction of the accused, of redirected towards the accuser in the form a defamation of character suit. The question is how much more finger pointing and name calling will the American people endure before independent candidates start being elected, shifting the us verus them paradigm that has equated the perception of American politics to that of American football?

A Department of Justice attorney admitted that “lost” emails from Lois Lerner’s hard drive do exist on an emergency backup system, Judicial Watch President Tom Fitton said today.

Fitton made the bombshell declaration during an appearance on Fox News:

"The Department of Justice attorney told the Judicial Watch attorney on Friday that it turns out the federal government backs up all computer records in case something terrible happens in Washington and there is a catastrophe. So the government can continue operating. They say it would be too hard to go get Lois Lerner's e-mails from that back-up system.
"Everything we've been hearing about scratched hard drives, missing e-mails of Lois Lerner, other IRS officials, other officials in the Obama administration, it's all been a pack of malarkey. They could get these records but they don't want to and they haven't told anyone about it, frankly, until we were able to get it out of them on Friday. There's no such thing as Lois Lerner's missing e-mails. It's all been a big lie. They've been lying to the courts, to the American people and to Congress."

Lerner’s hard drive has been the focus of the ongoing scandal involving the improper targeting of conservative groups based on political ideology. House Republicans have subpoenaed all email correspondence between Lerner and other governmental entities, including the White House. Current IRS Commissioner John Koskinen testified before the House Government Oversight Committee in June that the emails during the key period when the targeting occurred were “lost” due to a hard drive crash in 2011.

Judicial Watch has filed a lawsuit under the Freedom of Information Act (FOIA) for all “missing” records from the same time period at the IRS.
UPDATE: Judicial Watch has released a statement dubbing this a "jaw-dropping revelation" in the IRS scandal.

'Nobody Believes You': Ryan Blasts IRS Head Over Lost Emails

Some fireworks on Capitol Hill this morning as furious Republicans are calling out IRS Commissioner John Koskinen. Lawmakers are outraged after learning a week ago that many of former IRS official Lois Lerner's emails from a two-year period supposedly have disappeared.


New claims have surfaced that Lerner's hard drive was destroyed and emails from several other officials also have gone missing. Koskinen got the hearing off to a contentious start (video below) by telling House Ways and Means Committee Chairman Dave Camp (R-MI) that he doesn't feel an apology is owed for the lost emails.
Camp had challenged Koskinen about why he did not apologize in his opening statement.
Later, Rep. Paul Ryan (R-WI) went off on Koskinen, telling him simply "nobody believes you." He called out Koskinen for "burying" the disclosure about Lerner's lost emails in a 27-page letter to the Senate.
"You told us in May you were going to give us all of Lois Lerner's emails and you learned in February that [the computer] crashed," said Ryan. Koskinen denied that he knew about it in February.
"I have a long career. That's the first time anybody has said that they do not believe me," said Koskinen.
"I don't believe you," Ryan answered.
"That's fine. We can have a disagreement. I'm willing to stand on our record," said Koskinen, denying that the information about the emails was "buried" in the letter.
Afterward, Steve Hayes told Bill Hemmer he had never seen Ryan get that angry. Watch the exchange above.

Emails show Lerner targeting Senator Grassley

An amazing story broke last night as emails from Lois Lerner show that she wanted to refer Iowa Senator Chuck Grassley for an audit after an invitation to a party addressed to Grassley but delivered to Lerner showed the ogranization in question offering to pay travel expenses for Grassley's wife.The travel expenses would be perfectly legal as long as Grassley reported it.

Lerner's first instinct - before Grassley had even accepted the invitation - was to refer him for an IRS exam. Other emails show her colleagues eventually talking her out of it, but it certainly raises questions about what else might be in those missing emails.
Fox News:

he emails appear to show Lerner mistakenly received an invitation intended for Sen. Charles Grassley, R-Iowa, in 2012.
The event organizer, whose name is not disclosed, apparently offered to pay for Grassley's wife to attend the event, which caught Lerner's attention. The December 2012 emails show that in response, Lerner suggested to an IRS colleague that the case be referred for an audit.
"Looked like they were inappropriately offering to pay for his wife. Perhaps we should refer to Exam?" she wrote.
Her colleague, though, pushed back on the idea, saying an offer to pay for his wife is "not prohibited on its face." There is no indication from the emails that Lerner pursued the issue any further.
Republicans pointed to the exchange as yet another example of Lerner using her position in the Exempt Organizations unit to apply scrutiny to conservatives.
"We have seen a lot of unbelievable things in this investigation, but the fact that Lois Lerner attempted to initiate an apparently baseless IRS examination against a sitting Republican United States Senator is shocking," Ways and Means Committee Chairman Dave Camp, R-Mich., said in a statement.
"At every turn, Lerner was using the IRS as a tool for political purposes in defiance of taxpayer rights."
Grassley said in a statement that this kind of incident fuels concerns people have about "political targeting" at the highest levels. "It's very troubling that a simple clerical mix-up could get a taxpayer immediately referred for an IRS exam without any due diligence from agency officials," the senator said.
The IRS, in response to the publication of the emails, said in a statement that it could not comment on "any specific situation" due to taxpayer confidentiality issues.

Greta Van Sustern and her panel had a hard time believing the story:
Lerner can't be alone in this. Higher ups have to enable her actions - or put a brake on them as is what happened in this case. It's remarkable that the more congress digs, the more shocking the revelations. Just where is the bottom of this scandal?
Grassley is one of the most powerful Senators in Washington and Lerner's willingness to go after him either shows a suicidal arrogance or the confidence of Lerner that her superiors will back her up.

Based on a 2009 article that appeared in the Washington Post and a March 2013 report by CNN, Rep. Steve Stockman (R-TX) – who authored a resolution calling for the Sergeant at Arms to arrest Lois Lerner for contempt of Congress – should perhaps point to a much more significant crime in response to any concerns that Lerner could become a sympathetic figure if she were arrested. That crime involves Lerner's alleged illegal backdating of a tax exempt approval letter for an organization whose founder does business with a State Sponsor of Terrorism, business the Post says is illegal.

Here is what CNN reported in 2013:

As Shoebat.com has demonstrated for over a year now, Malik Obama – the brother of the President of the United States – has been "doing business with Sudan" since at least 2010, a year prior to when Lerner granted him tax exempt status.
Stockman was interviewed by Megyn Kelly about his resolution and one of the counterarguments raised by Kelly was that if the Sergeant at Arms is ordered to arrest Lerner, Republicans risk making Lerner a sympathetic figure. Stockman, whom we believe is well aware of the Malik Obama angle to the scandal (based on his trips to Egypt earlier this year), didn't seem concerned with Lerner garnering sympathy during his interview:
