New Jersey Assemblywoman Calls for mandatory home inspections of Gun-owners

January 29, 2013

New Jersey has taken a further step towards an Orwellian state with the introduction of Assembly Bill 3676, the text of which reads,

“28 (9) To any person who has not submitted the results of a 29 psychological examination administered by an appropriate health
30 care professional licensed in this State. The Superintendant of State
31 Police shall promulgate guidelines concerning the content of the
32 psychological examination, the qualifications necessary to
33 administer the psychological examination, maintaining
34 confidentiality of the subject of the examination, compliance with
35 federal law, and any other guidelines deemed necessary for the
36 successful implementation of this paragraph; or
37 (10) To any person who has not had an on-site inspection and
38 evaluation of the household where the firearm will be situate, the
39 purpose of which is to ensure the person is qualified to purchase the
40 firearm as required by subsection c. of this section.”

The biggest concern is in lines 37-40. These clearly outline that in order to purchase a firearm in the state of New Jersey, one must now submit their homes to an inspection by the state. This legislation is an unthinkable abuse of government power, and a serious violation on the civil liberties of millions of NJ residents. Under the law, an un-named organization, likely the already under-staffed, and over-worked NJ State Police, or local police departments will have to perform these inspections. Which, considering the Firearm Purchaser ID system NJ uses costs millions of dollars, and thousands of man-hours of work for the NJ State Police, will only waste more money enforcing a system that is not as good as the current Federal Background Check system. Now, I do not believe that anyone, of any political ideology, can support a bill this draconian. Whether you support guns or not, to endorse the search of one’s home when they have not committed a crime goes against everything our justice system was founded on. NJ gun owners are already marginalized, and treated as second-class citizens, despite the fact that there are over 1,000,000 legal gun owners in the Garden State. Americans should not be forced to sacrifice any of the rights guaranteed in the constitution, and millions of upstanding NJ residents are about to be forced to choose between their Fourth Amendment and Second Amendment rights.

The Author of the bill, Assemblywoman Angelica Jimenez, whether you are a NJ resident or not, if you are an American, and a person who believes that no one should be subject to illegal searches, please, contact her officer, and tell her how you feel.
