    Obama issues first pardons (nine of them)

    Another first from President Obama -- his first pardons.

    At first glance, none appears to be controversial.

    "The President was moved by the strength of the applicants' post-conviction efforts at atonement, as well as their superior citizenship and individual achievements in the years since their convictions," said a statement from White House spokesman Reid Cherlin.

    Here are the lucky nine winners, per the White House:

    James Bernard Banks - Liberty, Utah

    Offense: Illegal possession of government property. Sentence: Oct. 31, 1972; District of Utah; two years of probation.

    Russell James Dixon - Clayton, Ga.

    Offense: Felony liquor law violation. Sentence: June 23, 1960; Northern District of Georgia; two years of probation.

    Laurens Dorsey - Syracuse, N.Y.

    Offense: Conspiracy to defraud the United States by making false statements to the U.S. Food and Drug Administration. Sentence: Aug. 31, 1998; District of New Jersey; five years of probation and $71,000 restitution.

    Ronald Lee Foster - Beaver Falls, Pa.

    Offense: Mutilation of coins. Sentence: Oct. 4, 1963; Eastern District of North Carolina; one year of probation and $20 fine.

    Timothy James Gallagher - Navasota, Texas

    Offense: Conspiracy to distribute and possess with intent to distribute cocaine. Sentence: Oct. 18, 1982; District of Arizona; three years of probation.

    Roxane Kay Hettinger - Powder Springs, Ga.

    Offense: Conspiracy to distribute cocaine. Sentence: March 31, 1986; Northern District of Iowa; 30 days in jail followed by three years of probation.

    Edgar Leopold Kranz Jr. - Minot, N.D.

    Offense: Wrongful use of cocaine, adultery and writing three insufficient fund checks; Articles 112a and 134, Uniform Code of Military Justice.

    Sentence: Sept. 14, 1994, as approved Nov. 4, 1994; General court-martial convened at Hickam Air Force Base, Hawaii; bad conduct discharge (suspended), 24 months of confinement and reduction to pay grade E-1.

    Floretta Leavy - Rockford, Ill.

    Offense: Distribution of cocaine, conspiracy to distribute cocaine, possession of marijuana with intent to distribute, and possession of cocaine with intent to distribute. Sentence: Oct. 19, 1984; District of Kansas; one year and one day in prison and three years of special parole.

    Scoey Lathaniel Morris - Crosby, Texas

    Offense: Passing counterfeit obligations or securities. Sentence: May 21, 1999; Western District of Texas; three years of probation and $1,200 restitution, jointly and severally.

    Gov. Schwarzenegger issues last day commutations

    SACRAMENTO, Calif. -- Gov. Arnold Schwarzenegger on Sunday commuted the manslaughter sentence of the son of California's former Assembly speaker and also granted clemency to a woman who killed her former pimp in a motel room when she was 16.

    The moves come just hours before Schwarzenegger is scheduled to leave office on Monday.

    Schwarzenegger said he believed the 16-year prison sentence that Esteban Nunez was serving was "excessive" in reducing his sentence from 16 years to seven years.

    Nunez is the son of Fabian Nunez, a Democrat who served as Assembly speaker - one of the most powerful political leadership positions in the state - from 2004 to 2008.

    Nunez pleaded guilty in May to voluntary manslaughter and assault with a deadly weapon for his role in a fight that killed a 22-year-old man near San Diego State University in 2008.

    Prosecutors said Nunez and friends went looking for a fight after they were refused entry to a fraternity party. Defense attorney Brad Patton said the men acted in self-defense after getting into a fight with the victim as they left the party.

    The governor's commutation documents point out that Nunez received the same sentence as co-defendant Ryan Jett, despite the court acknowledging that Jett was the person who actually stabbed and killed Luis Dos Santos, and that Jett had a significant criminal record while Nunez had none.

    "He was not the actual killer. But despite the evidence that Jett was a leader and instigator in the offense, and that he stabbed and killed Santos, the court sentenced Nunez to the same maximum prison sentence as Jett," the governor said in the order.

    "Considering Nunez's limited role in the killing and his clean prior criminal record, I believe his sentence is disproportionate in comparison to Jett's."

    Victim's father Fred Santos said the family was "outraged" at the commutation that he called an "absolute injustice."

    "The governor did not even have the courtesy to notify the victim's family," Santos told The Los Angeles Times. "This is dirty politics: cutting backroom deals. I guess if you're the son of somebody important you can kill someone and get all sorts of breaks."

    The governor also granted clemency to Sara Kruzan, who was sentenced to life in prison without possibility of parole for the 1994 shooting death of George Gilbert Howard. Schwarzenegger reduced her sentence to 25 years to life in prison with the possibility of parole.

    Prosecutors said Kruzan was no longer working for Howard when she killed him. Her clemency petition cited years of abuse and psychiatric reports saying she suffered from battered women's syndrome.

    Sen. Leland Yee, who advocated for Kruzan, said she had turned her life around in prison and could be a role model for abused kids if released. Her case was the centerpiece of Yee's failed bill to allow reduction of life sentences for minors.

    Schwarzenegger also issued seven pardons, one conditional pardon and one other commutation late Sunday.

    Democrat Jerry Brown is scheduled to be sworn in as governor Monday morning.

    Gov. Rick Perry grants pardons; search our database for pardons made since 2000

    Gov. Rick Perry granted clemency to eight individuals after each case was favorably recommended for clemency by the Texas Board of Pardons and Paroles.

    Among those granted clemency:

    Paul Levi Engle, 57, of Odessa, was convicted of burglary in 1986 at the age of 32. He was sentenced to a four-year probated sentence, paid $250 restitution and was released from probation after three years. He was granted a full pardon.

    Allison Renee Allison, formerly Allison Coleman, 46, of DeSoto, was convicted of theft in 1985 at the age of 21. She was sentenced to 30 days in jail, which was probated for 12 months, and given a $400 fine. She was granted a full pardon.

    Josephine Elaine Herrera, 48, of Round Rock, was convicted of theft in 1990 at the age of 27. She was given a $100 fine and paid $247.50 restitution. She was granted a full pardon.

    Commutation of Nunez sentence draws fire from local prosecutors

    SAN DIEGO — Two top prosecutors in San Diego County on Monday condemned Gov. Arnold Schwarzenegger’s decision on his last day in office to reduce from 16 years to seven years the prison sentence for Esteban Núñez, who pleaded guilty to voluntary manslaughter in a 2008 stabbing.

    Núñez and three other Sacramento men originally faced murder charges stemming from a fight at San Diego State University that led to the stabbing death of Luis Santos, a 22-year-old Mesa College student. Núñez is the son of former Assembly Speaker Fabian Núñez, a Los Angeles Democrat and San Diego native.
