    COUNCIL BLUFFS, IA — A man says that while he was working on his tractor in his driveway, a van pulled up and a dozen men with rifles piled out and assaulted him. As they bashed his head in, breaking bones in his face, he believed they were there to kill him. It was later determined that police had attacked a completely innocent man due to a false police report, drawing questions about why police acted so brutally against a man who did not resist and made no threats.

    The violence befell upon John Hytrek one day in August 2012 while he was working on a tractor at his shop. Without warning, Mr. Hytrek heard a van screeching up to his shop. When he looked up, roughly 12 men were sprinting towards him with their rifles drawn.

    “They ran for me with machine guns,” recalled Mr. Hytrek to KMTV. “And I looked at them, and I’m like, what!?”

    Hytrek was completely blindsided and had no idea what was going on. The trespassers tackled him to the ground, driving his face into a piece of steel equipment. Hytrek then says he was struck in the head multiple times.

    “Five times,” said Hytrek to the local news station. “I think it was boom, boom, boom, boom, boom.” He demonstrated the blows coming from multiple directions.

    He was struck so hard that assailants actually shattered the lenses in his glasses.

    “I was minding my own business, you know, and they came in for the kill,” Hytrek said.

    SEATTLE - Seattle police officers are filing a federal lawsuit challenging new policies that restrict use of force. They say the rules endanger lives of both officers and civilians. Some 120 officers have joined the lawsuit, which seeks a complete dismantling of a new use of force policy hammered out between the Seattle Police Department and the U.S. Department of Justice to stem an alleged pattern of excessive force.

    Cop stands on hood of car, fires 15 rounds through window, kills two unarmed people

    A Cleveland police officer is being charged with two counts of man slaughter after teaming up with 5 other officers who shot and killed 2 unarmed citizens in blaze of pistol smoke

    The Associated Press reported in a recent article titled 6 Cleveland Officers Indicted in Deadly Car Chase:
    “This was now a stop-and-shoot — no longer a chase-and-shoot,” McGinty said. “The law does not allow for a stop-and-shoot.”
    Driver Timothy Russell was shot 23 times. Passenger Malissa Williams was shot 24 times. No gun was found on them or in their vehicle. The chase began when an officer thought he heard a gunshot from a car speeding by the police and courts complex, jumped into his patrol car and radioed for help. Police don’t know why Russell didn’t stop.

    Brelo fired 49 shots. None of the other 12 officers who fired shots were indicted, McGinty said Friday.

    Shockingly during the hail of gunfire, patrol officer Michael Brelo was reported to have stood on the hood of the suspects car, firing at least 15 rounds into the two, reducing them to a bloody pulp.

    Woman sent to Berks County Jail on truancy charges dies
    BERN TWP., Pa. - A woman died at the Berks County Jail in Bern Township on Saturday.
    Some legislators are questioning why how she died and why she was in jail in the first place.
    "I have questions as well as what happened to the woman in prison. How did it happen that she passed away? Did she need medical attention and not receive it," said PA Senator Judy Schwank, (D) Berks County.
    Eileen Dinino, 55, was a mother of seven. She was serving a 48-hour sentence for her children's multiple truancy violations. But some legislators cannot come to grips with her sentence.
    "I cannot understand how someone ends up going to jail. They did not murder someone, they did not steal, they did not commit a felony. How does jail time equate to resolving this particular problem?" said Sen. Schwank.
    Dinino had a total of 55 violations against her for her children missing numerous days of school in both Reading and Muhlenberg Township.
    Under state law, you can be sentenced to five days in jail for every violation.
    "That unfortunately is part of the law in Pennsylvania and I think it is insanity. There has got to be a better way to deal with truancy than putting somebody in prison," said Christian Leinbach, (R) Berks County commissioner.
    Schwank suggested maybe community service or a payment plan for the fines would have been more beneficial.
    But Leinbach is calling for an outright change to the existing law.
    "I think there are better ways to deal with nonviolent crimes. I am not even sure quite frankly that things like truancy and parking should be criminal offenses and frankly support legislation that would decriminalize those offenses," said Leinbach.
    Dinino died 24-hours into her sentence. An autopsy was performed, but the coroner is awaiting toxicology results before deciding the cause of death.
    Officials say nothing indicates the death was suspicious.

    SAN ANTONIO — San Antonio has twice the number of people living with diabetes than the national average.
    That’s why we thought it was important to bring you the story of a local diabetic who was severely injured during a scuffle with police.
    We want to be very transparent here, the gentleman happens to be a family member of News 4 San Antonio’s Delaine Mathieu.
    For that reason she has not been involved in our coverage or investigation of the incident.
    News 4 Trouble Shooter Jaie Avila has the police video of what happened – and why diabetes plays an important role.
    70-year old Thomas Mathieu doesn’t fully remember the incident that sent him to the hospital with injuries to his face, head and arms, as well as three broken ribs. When we interviewed him in mid-January, Mathieu had also developed a serious case of pneumonia.
    “None of it adds up because I am, basically a gentle person,” he said.

News 4 San Antonio obtained police dash cam video from January 13th of this year. Two SAPD officers responded to the Loop 410 Frontage Road, where it meets Evers Road. That's where Thomas Mathieu had stopped his car in the turn lane, because he felt he was about to have a low blood sugar episode. He says he didn't want to put others in danger. "I don't know what happened from there on," said Thomas Mathieu. "I woke up with my face in the ground." The officers arrived to find Mathieu slumped over the steering wheel, and told him three times to step out of the vehicle. Mathieu, who says he was not conscious at this point, refused to get out of the car and a struggle began. The officer punched Mathieu several times to get him to comply. In the officer's report, he wrote that he struck Mathieu because he thought he was reaching for the car shifter to drive off. The officer said he feared the car might injure him or hit other vehicles, so he continued to punch Mathieu in the head. After about 30 seconds, the two officers pulled Mathieu out onto the roadway. But the struggle continued as they try to turn him over. During the incident, Mathieu can be heard, crying out as officers threatened to tase him. The officers finally gain control over Mathieu, just out of view of the camera, and it's clear they believe they are dealing with a person who is under the influence of alcohol. Here is the exchange that then ensued between the officer and Mathieu: Officer: Sir, how much have you had to drink tonight? Mathieu: Nothing. Officer: Nothing? Mathieu: No! Officer: What's going on with you today? Mathieu: Nothing. Officer: Why were you sleeping behind the wheel, sir? And when we asked you to get out you didn't get out. Why? It's not until about one minute later -- a full five minutes after police arrived. that someone asked Mathieu if he was a diabetic. Mathieu and his family say police should be trained to ask questions first to determine if there's a medical emergency. "I know officers are trained how to deal with diabetic situations but apparently there was no recognition of that situation here," said Mathieu. When asked about the incident, SAPD Chief Bill McManus says the case was investigated by internal affairs and sent to the advisory action board made up of seven officers and seven civilians. They determined excessive force was not used and cleared the officers. McManus says officers do receive extensive training on how to recognize a diabetic episode, but they didn't have a chance to use it in this case because the first priority was getting Mathieu out of the driver's seat. The American Diabetes Association has been trying to get police departments around the nation to improve officer training. After Philadelphia police were hit with a class action lawsuit, the department produced a video teaching officers how to properly deal with diabetics.
