HOUSE BILL 70
ILLEGAL IMMIGRATION ENFORCEMENT ACT

LONG TITLE
General Description: This bill modifies state law and enacts the "Illegal Immigration Enforcement Act."
This bill:
requires that an officer verify the immigration status of a detained or arrested person upon reasonable suspicion the person is an illegal alien, and provides enforcement exceptions; clarifies when passengers in a vehicle where the operator has been detained may also be questioned and their immigration status verified; requires that a law enforcement officer may not consider race, color, or national origin, except as permitted by Utah and United States constitutions; States grounds for a presumption of a person's lawful presence in the United States; provides for transportation of an illegal alien to federal custody by a state or local law enforcement officer; provides that a state or local agency may not limit, by any means, the authority of any law enforcement or other governmental agency to assist the federal government in the enforcement of any federal immigration law, including the federal requirement to register as an alien or possess an alien registration document; provides that any state or local governmental agency is not restricted in sending, receiving, or maintaining immigration status information of any person in carrying out the agency's lawful purposes; requires verification of immigration status regarding application for public services, benefits, or licenses provided by a state or local governmental agency or subcontractor; provides that this bill does not implement or authorize the federal REAL ID Act to any extent not currently provided by state law; provides that a legal resident may, after establishing standing, bring action against an agency that limits enforcement of federal immigration laws and imposes financial penalties for violation; provides that penalties imposed on the agencies be directed to the multi-agency
strike force that deals with crime associated with illegal immigration and human trafficking; amends the current state law prohibiting transporting or harboring illegal aliens by removing the limitation to transportation of the alien for a distance greater than 100 miles; prohibits the encouraging or inducing of an illegal alien to come to or reside in Utah; amends peace officer arrest authority to include making an arrest when the officer has reasonable cause to believe the person is an alien:subject to an immigration removal order; and regarding whom a detainer warrant has been issued who has committed or been charged with a felony in another state.

EMPLOYMENT OF UNAUTHORIZED ALIENS

General Description:
This bill modifies provisions related to labor to address verification of an individual's eligibility under federal law to be employed.
Highlighted Provisions:
This bill:
enacts the Employment of Unauthorized Aliens Act, including:
. defining terms;
. addressing construction, severability, and compliance with federal and state law;
. prohibiting the knowing or intentional employment of unauthorized aliens;
. requiring verification of employment eligibility;
. imposing verification requirements for economic development incentives;
. providing for voluntary registration;
. requiring certification by government entities of compliance with verification requirements; and
. providing for enforcement; and
. repeals the Private Employer Verification Act.

Other Special Clauses:
This bill takes effect on July 1, 2011.

SENATE BILL 41
HEALTH AMENDMENTS FOR LEGAL IMMIGRANT CHILDREN
STATE OF UTAH

LONG TITLE
General Description:
This bill amends the Medical Assistance Act and the Utah Children's Health Insurance
Act to provide Medicaid coverage and health insurance coverage to a legal immigrant child, regardless of the length of time that the child has been in the United States.
Highlighted Provisions:
This bill:
. exercises the option to remove the five-year residency requirement for a legal immigrant child to be eligible for coverage under Medicaid or the Utah Children's Health Insurance Program; and directs the Department of Health to amend the state Medicaid plan and the Utah Children's Health Insurance Program to provide coverage to an eligible legal immigrant child, regardless of the length of time that the child has been in the United States.

Other Special Clauses:
This bill takes effect on July 1, 2013.

General Description:
This bill repeals an exemption from the nonresident portion of total tuition within the State System of Higher Education.
Highlighted Provisions:
This bill:
repeals the provision that, if allowed under federal law, a student, other than a nonimmigrant alien, is exempt from the nonresident portion of total tuition if the student: attended high school in the state for three or more years; and graduated from a high school or received its equivalent in the state; and makes technical changes.

An illegal immigration enforcement bill modeled after Arizona legislation passed Friday in the House in Utah.
HB70, sponsored by Rep. Stephen Sandstrom, R-Orem, was approved 58-15 after nearly two hours of often impassioned debate on the House floor.

Panel votes to end tuition break for undocumented students

After emotional pleas from both sides, a House committee voted 10-5 on Friday to repeal resident tuition for state college students who are in the country illegally but graduated from a Utah high school.
The vote left several students crying and hugging.
“The purpose of this bill is to do away with taxpayer-subsidized discount tuition that we give to illegal immigrants to go to college,â€
