Source: 'Bandits' Shot Border Agent To Death
4 People In Custody, 1 Still On Loose

    UPDATED: 1:34 pm MST December 15, 2010

NOGALES, Ariz. -- A U.S. Border Patrol agent was killed during an exchange of gunfire between agents and several armed individuals near the Arizona-Mexico border Tuesday night.

The head of a Border Patrol agents' union said agent Brian A. Terry was shot to death north of the Arizona-Mexico border while trying to catch bandits who target illegal immigrants.

National Border Patrol Council President T.J. Bonner said Terry was waiting with three other agents in a remote area north of Nogales late last night when a gun battle with the bandits ensued. No other agents were injured, but one of the suspects was wounded in the shootout.

The Border Patrol said that Manuel Arianes, a.k.a. Manuel Arellanes Osorio, was wounded in the gunfight.

Arianes, 34, and a Mexican national, was convicted in Maricopa County Superior Court in 2006 for aggravated assault, and had been deported to Mexico twice, according to sources familiar with his case.

Border Patrol spokesman Eric Cantu and FBI spokeswoman Brenda Lee Nath declined to confirm Bonner's account, but said authorities have four suspects in custody and are searching for a fifth.

FBI Special Agent Manuel J. Johnson confirmed authorities were still searching for a fifth suspect.

Johnson said Terry died shortly after he was shot about 11:15 p.m. in a remote and rugged area near Rio Rico, just north of Nogales.

No names of those in custody were available, Johnson said.

"Our thoughts and prayers are with the Terry family for their tragic loss," said U.S. Customs and Border Protection Commissioner Alan Bersin.

"Our commitment to Agent Terry and his family is that we will do everything possible to bring to justice those responsible for this despicable act" Bersin said.

The FBI is leading the investigation with cooperation of the Santa Cruz County Sheriff's Office, according to CBP.

"Today we are deeply saddened by the loss of Agent Brian Terry, a patrol officer from the Nogales Border Patrol Station," the Arizona Cattleman's Association said in a news release. "We are thankful for his dedicated service to protecting the United States of America."

U.S. Sen. John McCain, R-Ariz., said, "This event is yet another reminder of the dangers the men and women of the Border Patrol face every day as they put their lives on the line to protect the American people.

"The increased violence in the border region demands that Congress provide the necessary resources and personnel to ensure the safety of all Americans, especially border patrol agents stationed on the border, and fulfill the Federal government's responsibility to secure our border," McCain said.

Yes!! I have been saying that for years. The people who are so in love with illegals have Maria clean their house, Juan does their lawn, and it is so lovely for them. But then Maria and Juan come home to our neighborhoods that used to be nice, but has turned into a slum. And then Maria spits out 7 or 8 future gang-bangers that we have to fear. Juan in the meantime is getting drunk and driving because we all know how hard he works and he deserves it. He has no license or insurance, but hey, he has to get around. No harm will ever come to the rich folk who hire them and just love them to death because they work so cheap.

Department of Homeland Security secretary Janet Napolitano:

“The fatal shooting of Border Patrol Agent Brian A. Terry last night is an unconscionable act of violence against the men and women of the Border Patrol and all those who serve and defend our country.

Agent Terry was killed in the line of duty while confronting several suspects near Rio Rico, Ariz. It is a stark reminder of the very real dangers our men and women on the frontlines confront every day as they protect our communities and the American people.

We are working with other federal, state and local authorities to ensure those responsible for this horrendous act are held responsible. We will leave no stone unturned as we seek justice for the perpetrators.

I want to extend my deepest condolences to Agent Terry’s family at this difficult time. We will honor his memory by remaining resolute and committed to the serious task of securing our nation’s borders. I ask that all of us keep Agent Terry and his family in our prayers.â€

Border Patrol Agent Brian A. Terry, killed by suspected border bandits Tuesday near Rio Rico, had a long history of military and law enforcement service.

Terry, a Detroit native, served three years in the U.S. Marine Corps before being honorably discharged in 1994, the Border Patrol said Wednesday.

Following his discharge from the Marines, Terry worked as a police officer in Michigan before joining the Border Patrol in 2007, said Brandon Judd, president of the Border Patrol agents’ Local 2544 union.

“So even though he only had three years with the Border Patrol, he was very experienced as far as law enforcement goes,â€

Congressman Calls on Obama to Take Illegal Immigration 'Seriously' Following Death of Border Agent

Aug. 10: Rep. Lamar Smith, R-Tex. , speaks during a news conference on Capitol Hill in Washington, announcing a resolution condemning the Proposition 8 decision in California on same-sex marriage.

On Wednesday, Smith called on the Obama administration to secure the U.S.-Mexico border following the murder of a U.S. Border Patrol agent. (AP)
The incoming chairman of the House Judiciary Committee said the shooting death of a U.S. Border Patrol agent is a "sad reminder" of the dangers law enforcement officers face on a daily basis and called on the Obama administration to secure the U.S.-Mexico border.

House Judiciary Committee Chairman Elect Lamar Smith, R-Texas, said the killing of Brian A. Terry in southern Arizona late Tuesday should serve as wake-up call to President Obama and his administration.

"The Obama administration’s lax enforcement of immigration laws, coupled with calls for mass amnesty, only encourage more illegal immigration," Smith said in a statement released Wednesday. "Our border remains porous and the Obama administration has done nothing to stop the steady flow of human and drug smuggling from Mexico."

Agent Brian A. Terry, 40, was killed late Tuesday near Rio Rico, Ariz., according to a statement released by U.S. Customs and Border Protection (CBP) officials. At least four suspects are in custody and another is still being pursued.

The leader of a union representing Border Patrol agents said Terry was trying to catch bandits who target illegal immigrants for robbery.

National Border Patrol Council President T.J. Bonner said Terry was waiting with three other agents in a remote area north of Nogales when a gun battle began. A CBP spokesman would not confirm that account.

Prior to Terry's death, the last fatal shooting of a Border Patrol agent was on July 23, 2009, when Robert Rosas, 30, was killed by unidentified assailants while responding to suspicious activity in a known smuggling corridor near Campo, Calif., CBP officials said.

Since 2005, according to Smith's statement, roughly 28,000 people have been killed along the U.S.-Mexico border, including 1,000 law enforcement officers.

"The murder of Border Patrol Agent Brian Terry is a sad reminder of the real-life dangers that Americans and our law enforcement agents face along the southwest border," Smith's statement continued. "What will it take to make the Obama administration realize that we must do more to secure our border and keep Americans safe? Earlier this year, a rancher in Arizona was killed on his own property. The suspect is believed to have been an illegal immigrant. Last night, Border Patrol Agent Terry lost his life for simply doing his job. How many more Americans will die before the Obama administration wakes up and starts taking illegal immigration seriously?"
