The world court and President Bush tried and failed to stop the execution of illegal alien Death Row killer Jose Medellin.
Texas told ‘em to bug off–and the Supreme Court backed Texas.
Medellin faces execution tomorrow. The U.N. and the international meddlers are whining. Now, Medellin’s lawyers have filed one last-ditch appeal to subvert our national sovereignty and delay justice:

I propose that Texas become the new national capital. Ted Poe and others of his ilk should be in charge of illegal immigration, GOP revolts, and drilling here, drilling now.
The flag flies at half-mast out of grief for the death of my beautiful, formerly-free America. May God have mercy on your souls.

The Governor of Texas was on today talking about this execution and he said that the brutality of the crimes against the young girls warranted the death of this man. He again mentioned the watch of one of the girls being given to a girl friend of the murderer.

Coming up, despite pleas from the world court, there`s an illegal alien that is scheduled to be executed tomorrow for the rape and murder of a teenage girl in Texas. We have the governor of Texas on. I`m going to ask him if he`ll arrange that meeting between this murderer and Jesus tomorrow. We`ll get his answer next.
And a man trying to live out his final days in peace, he has his life turned upside down after a neighbor discovers a miracle in his back yard. Luke Wilson and George Lopez star in "Henry Poole is Here." Remarkably, almost miraculously, they`re both going to be on -- on this program. Stick around.

BECK: Back in 1994, Mexican national -- his name, Jose Medellin. He was convicted of leading a gang that raped and murdered two teenage girls in Houston. It was brutal, and it earned him some Lone Star justice: the death penalty.
The Mexican government protested. They were joined from -- joined by some unlikely allies: members of Congress, even President Bush. They say that Medellin was denied access to his consulate. Went all the way to the Supreme Court.
Texas sees it another way. They see it as you come to our state, murder two teenage girls, you die. Medellin is scheduled to be executed tomorrow.
I`m joined now by Texas governor Rick Perry.
Governor, you were -- you were at my comedy stage show -- I don`t know, you know -- three, four weeks ago. I asked you before I went onstage, are you going to arrange a meeting between Jesus and Medellin? You said yes.
GOV. RICK PERRY (R), TEXAS: I told him that was my -- that was my duty. The state of Texas would be the judge and jury of that, of which they`ve been.
And Mr. Medellin is being treated like anyone who would come into our state and commit a heinous crime. He`s been given every opportunity through our court systems, very fairly and very openly. He has appealed. He`s lost those appeals, up to and including our core criminal appeals as late as last Thursday. And our parole board will make a judgment call this afternoon, and then I will make my decision.
BECK: OK. So the -- it`s plain for anybody who doesn`t know who this guy is. Explain why. You said to me that this the worst case you have ever read about.
PERRY: Jose Medellin, who lived in the United States for half of his life, he was born in Mexico but he read and spoke and was very involved in the community from the standpoint of living and working there. I mean, he knew his way around the state of Texas.
But this was the most heinous crime that I`ve had across my desk. There were six young individuals. When I say young, 17 -- two of them were 17. Three of them were above the age of 18. Raped and brutally murdered, two young, beautiful Texas teenage girls, 14 years old. Orally, vaginally, anally raped them for over an hour. And then they murdered them, stomped them, kicked them, slashed them. It was -- it was an incredibly heinous act.
BECK: He took the watch of one of the girls and gave it to his girlfriend, and he was bragging about what he had done.
PERRY: I think that`s a good reflection of the type of individual that we`re dealing with here.
BECK: OK. So everybody really agrees that this guy should be executed, yet George Bush passed this on to the Supreme Court and said, "Maybe we should listen to the -- the world court." Why would he do that?
PERRY: I don`t know. I think there`s a lot of over-lawyering going on, from my perspective. The facts are very clear in the case. I mean, Mexico couldn`t hire O.J. Simpson`s lawyers and get this fellow off in Texas. That`s the bottom line on this.
He never told the authorities he was a Mexican citizen. Never asked for consulate notification, either in the trial phase or in the punishment phase or in the appeals phase.
This is the classic example of the anti-death penalty people trying to find some interesting legal argument. They`re throwing things up against the wall, Glenn, hoping something will stick.
BECK: Sir, I hope that you do, indeed, arrange that meeting tomorrow night between him and Jesus. Let -- let the Lord sort it out.
Governor, thank you very much.
PERRY: We`re just doing the justice part in Texas.

On Monday afternoon, in the courtyard of his house, Venancio Medellin went to look lost and with eyes still pink.I did not know if the last five hours just to spend with his son, Jose Ernesto Medellin, marked the last occasion that he would see his eldest son alive.
Jose Ernesto Medellin, 33, is scheduled for the afternoon today (Tuesday, August 5) its rendezvous with death unless a decision last minute, will be executed in prison Huntsville, Texas for having participated along with five others in the murder and rape of two girls (Jennifer Ertman and Elizabeth Peña 16 and 14 years) on June 24, 1993 in a park called TC Jester in northwest Houston.
"I am not fighting if my son is innocent or not, I know that what he did was wrong and must pay the consequences, but also should respect the laws laid down," he said Venancio father of five.
The International Court of Justice (ICJ) called for the trial of Jose Ernesto Medellin, like the other 50 Mexicans, was revised because they are not respected the right to consular protection of the accused.
Venancio Medellin, a native of Nuevo Leon, who admitted the possibility that her son escape from execution is minimal, but said his family would wait with hope until the last minute.
"I do not know if we are going to see him leave on Tuesday before the execution but we will make the trip," said Venancio rumba to two hours after visiting his son in a detention centre in Livingston, Texas.
"We were like water in your hand five hours we were with Jose, we would have liked to have been longer but my son wanted the other three hours of the eight allowed to see other friends," added the father .

The other son of Venancio who participated in the murders, also called Venancio Medellin, was sentenced to 40 years, having collaborated with the authorities.
The father said that the fifteen years that have passed since the crime had been an "ordeal" for his family as they have consistently been the target of death threats and insults; several times had to change his domicile.
"I am very sorry for the family of girls and could return if the weather would do so this would not have happened, but we can not," he said.
At its meeting on Monday were Venancio, Jose Ernesto's mother, Maria Rojas, and the two grandmothers prisoner.
"The mother of my wife came from San Luis in the hope of seeing his grandson, fortunately we were allowed to enter, she looked not my son since he was three years, gave much joy to Jose Ernesto see their grandmother boards" "Said Venancio.
The paternal grandmother, Eleuteria Armendáriz Perales, traveled to Nuevo Laredo to see the grandchild she crÃ*o up to nine years.
"Jose spoke with his grandmother for making mischief when he was small and the food that my mom (Eleuteria) did when he lived with her in Nuevo Laredo."
On the mood of Jose Ernesto, his father said that was strong before his mother and his grandmother.
"But it's my son and I do not fool, I noticed something nervous yet quiet and hope that there will be a miracle, he does not want to die," said the father.
The last time Venancio had seen his son was on May 3 when Jose Ernesto was held in the Harris County jail in downtown Houston, where he was transferred to attend a court hearing and its implementation date.
"Before launch in May llevábamos seven years not to Mir and this time you looked at the centre was very short, so this time we were with him we were short," said Venancio.

"My mind is with my son and that while it takes years knowing that he is going to run, there is no way to prepare for the death of a child," he said.
