A Guatemalan migrant, who entered the United States in 2018, has been arrested for allegedly setting a woman on fire while she slept on a New York City subway train. The victim, whose identity remains unknown, burned to death as the suspect calmly watched, making this one of the most depraved acts of violence in recent memory.

A Guatemalan migrant has been arrested for allegedly lighting a sleeping subway rider on fire in Brooklyn on Sunday morning — then watching as his innocent victim burned to death in what the police commissioner called “one of the most depraved crimes one person could possibly commit.”

The savage killing — which happened at about 7:30 a.m. on an idling F train at the Coney Island-Stillwell Avenue station — shocked commuters, MTA workers and NYPD Commissioner Jessica Tisch, who said Sunday that the heinous crime “took the life of an innocent New Yorker.”

Officials said the 33-year-old suspect came to the US in 2018 from Guatemala.

“As the train pulled into the station, the suspect calmly walked up to the victim, who was in a seated position at the end of a subway car … and used what we believe to be a lighter to ignite the victim’s clothing, which became fully engulfed in a matter of seconds,” Tisch said at a press conference.

Patrolling cops smelled and saw the smoke, then followed it to the flame-covered woman, the commissioner said.

They extinguished the blaze, but the victim died at the scene.

Officials said the 33-year-old suspect came to the US in 2018 from Guatemala. He was detained by border patrol agents in Arizona in June of that year, sources said. His legal status wasn’t immediately clear Sunday night.

He received a transit summons in May 2023, but his criminal record in New York City was largely clean otherwise, sources said. He was living at a shelter on Randall’s Island at the time of the infraction.

Horrifying video obtained by The Post showed the suspect calmly looking on as flames consumed the still-unidentified woman, who stood inside the open subway car door.

A transit cop walked by, and seemed to pull out a radio and say something as they continued down the platform.

After the cop passed, the suspect got up as if to walk away — then the clip cut off.

In another video, cops yelled to the gathered crowd, “Did anybody see anything? Did anybody see anything?” as smoke poured from inside the subway car.

The suspect brazenly sat on a nearby bench as cops huddled around, pulling his hood up at one point just before an officer spoke to him.

“Do me a favor? Walk down there,” the cop said, motioning down the platform with his radio. “I need this space cleared up.”

The man stood up, then left the scene.

“Unbeknownst to the officers who responded, the suspect had stayed on the scene and was seated on a bench on the platform just outside the train car,” Tisch said.



The suspect allegedly sat and watched the victim after the gruesome assault.

“The body-worn cameras on the responding officers produced a very clear, detailed look at the killer.”

Later in day, three high schoolers called police to say they saw the man pictured in images released by the NYPD at the Jay and York Street station on the F line, according to Tisch and the NYPD’s Chief of Transit Joseph Gulotta.

When transit officers responded to that call, they found the suspect already on another train leaving the station — and wearing the same gray hoodie, wool hat and paint-splattered pants he’d been wearing when he allegedly torched the woman.



The suspect brazenly sat on a nearby bench as cops huddled around, pulling his hood up at one point just before an officer spoke to him.

Cops called ahead and halted the train at Herald Square. Then, they went from car to car until they found the suspect and arrested him, police officials said.

Tisch said the suspect had a lighter in his pocket when he was picked up.

“I want to thank the young people who called 911 to help,” Tisch said. “They saw something, and they said something, and they did something.”

Gulotta echoed her comments, calling the arrest “amazing work done by the public and the police working together.”



The victim died at the scene.

Police don’t believe the migrant and the victim knew each other before the killing, Gulotta added.

Earlier in the morning, cops, firefighters and medical examiner personnel clad in white Tyvek suits combed the tracks for evidence after they cordoned off the area.

Around 1 p.m., authorities carried a body bag containing the woman’s corpse out of the train and placed it on a gurney. Then they wheeled it over to a medical examiner van and moved it inside.

The woman has not yet been identified.

New York Governor Kathy Hochul was slammed on social media Sunday after touting how safe the New York City subway system has become thanks to her efforts – just hours after a woman was set on fire and burned to death on a train.

In an X post on Sunday, Hochul claimed that crime has decreased on Big Apple trains since she deployed the National Guard in March. Last week, Hochul sent 750 National Guard members to the subways in an effort to curb holiday crime.

"2 people were murdered in the subway today," DeRosa wrote. "The governor of the state of ny is a tourist who can’t even bother to read a newspaper while she’s in town."

Advocacy group AntiSemitism called out the governor's communications employees, writing that Hochul "need[s] a new social media team."

Lori Mills, the vice chair of the Ventura County Republican Party, also responded to the poorly-timed tweet.
"You must have missed today’s news," Mills said bluntly to Hochul.

Sources identified the person of interest to Fox News Digital as 33-year-old Sebastin Zapeta, saying he entered the U.S. from Guatemala approximately a year ago, but whether he did so legally or illegally was unclear.

New Yorkers were up in arms Monday one day after an illegal Guatemalan immigrant allegedly burned a sleeping straphanger to death aboard a Brooklyn subway train — while bystanders did nothing.

Horrifying video footage of the incident shows at least three gawkers — one of them seen filming the shocking fatal blaze on his phone — and an NYPD cop standing outside the subway car as flames engulfed the unidentified victim after the Sunday morning attack.

Bystanders and even an NYPD cop were seen outside an F train where a woman was set on fire — but no one intervened.

“Nobody came to her aid,” said Guardian Angels founder and community activist Curtis Sliwa. “There’s no doubt that people don’t want to get involved. It’s the Daniel Penny factor. It’s frozen people. They’re saying to themselves: ‘I don’t want to get jammed up like Penny.

“People should have been running over to the woman on fire. They did nothing. They said nothing,” Sliwa said, calling the reluctance of bystanders to intervene “the Daniel Penny effect.”

Penny, a 26-year-old ex-Marine, was charged with murder last year for fatally choking vagrant Jordan Neely after Neely aggressively confronted frightened passengers on a Manhattan subway car.[/COLOR]

Penny was acquitted of criminally negligent homicide charges earlier this month.

But according to some observers, his legal ordeal is giving would-be subway good Samaritans pause.

“People are reticent about getting in the middle of criminal activity,” state Conservative Party Chairman Gerard Kassar, a Brooklyn resident, told The Post Monday. “There are a lot of New York City residents who think twice about acting because they don’t think they have the support of our Democratic elected officials. They are wary of revolving door justice.

“This murder never should have happened in the first place,” he said.

Meanwhile, the head of the state Senate committee that oversees the MTA said Monday he wants answers from the transit agency over shortcomings exposed by the incident.
“We’re asking for a breakdown of what happened, how it happened and why it took so long [to make an arrest],” state Sen. Leroy Comrie (D-Queens), who chairs the committee, told The Post Monday.

“Because of the actions of previous administrations, it’s a mess out there,” Comrie said. “There are too many [mentally ill] people who should be in facilities who are out in the streets. Some of these people need to be restricted in their movements.”

The lawmaker spoke one day after a migrant, identified by federal immigration officials as 33-year-old Sebastian Zapeta-Calil, was charged after the grisly incident on a Coney Island subway train.

Sources said charges are pending, with Brooklyn prosecutors awaiting the results of an autopsy — which is complicated by the scorched condition of the victims’ body — to determine the cause of death.
But the incident has raised several questions, including why it took cops so long to get to the burning woman, why Zapeta-Calil was allowed to leave the scene after cops arrived and why required fire extinguishers on the subway car weren’t put to use, sources said.
One former state pol took aim at Gov. Kathy Hochul, raising concerns over the state-run transit agency.
