Man gets nine-year sentence in fatal crash | Larry Brabeck

Family and friends of a Gilbert postal worker killed by a drunken driver last year got a measure of justice Friday when a judge handed him a nine-year prison sentence.

Larry Brabeck, 51, died the morning of Sept. 24 while driving to his job in Scottsdale. As Brabeck drove north on Val Vista Drive approaching U.S. 60, a pickup driven by Antonio Hernandez exited the eastbound off-ramp at a high speed, ran a red light and crashed into three cars.

Hernandez was later found to have a blood alcohol content of 0.13. The legal limit in Arizona is 0.08 ...

Hernandez, a Mexican national from Tennessee, kept his head deeply bowed during the hearing. He spoke only briefly, apologizing and asking for forgiveness.

Police and court records state Hernandez is 21, but prosecutors said that comes from fake identification he presented to authorities after the crash. The defense attorney for Hernandez said he was either 17 or 18.

“I don’t think anybody in this courtroom knows the defendant’s true age,” Peterson said.
