TYLER β€” Last night around 9:00 at the corner of Bois D'Arc and Gentry in Tyler, a traffic accident severly injured 9-year-old Cynthia Daniella and killed 12-year-old Alexandria Castillo.

Tyler Police say 33-year-old Jesus Soto was taken to Smith County Jail last night and is now charged with intoxication manslaughter as well as intoxication assault.

Police say last night a white pickup truck going west on Gentry struck Soto's gray chevy.

Soto was turning left on Bois D' Arc and failed to yield the right of way.

....and due to an immigration charge from ICE, Soto is unable to get out of the Smith County Jail at the moment - even with the criminal charges.

"However, he can make the bond on those charges, but still can't get out on the ICE hold because basically they're holding him until they can get a federal magistrate obviously involved in an investigation occuring to determine his status here as a citizen of the united states," said Sgt. Bill Goecking with Tyler Police.

This afternoon, we did try to speak with the family of the children, but they were too distraught to speak with us on camera.

12-year-old Alexandria died in a Tyler hospital at around 2 this morning.

9-year-old Cynthia is at the Childrens Medical Hospital in Dallas - in stable - but criticial condition.
