UPDATE: Drunk driver detained on immigration charge

TYLER — Last night around 9:00 at the corner of Bois D'Arc and Gentry in Tyler, a traffic accident severly injured 9-year-old Cynthia Daniella and killed 12-year-old Alexandria Castillo.

Tyler Police say 33-year-old Jesus Soto was taken to Smith County Jail last night and is now charged with intoxication manslaughter as well as intoxication assault.

Police say last night a white pickup truck going west on Gentry struck Soto's gray chevy.

Soto was turning left on Bois D' Arc and failed to yield the right of way.

....and due to an immigration charge from ICE, Soto is unable to get out of the Smith County Jail at the moment - even with the criminal charges.

"However, he can make the bond on those charges, but still can't get out on the ICE hold because basically they're holding him until they can get a federal magistrate obviously involved in an investigation occuring to determine his status here as a citizen of the united states," said Sgt. Bill Goecking with Tyler Police.

This afternoon, we did try to speak with the family of the children, but they were too distraught to speak with us on camera.

12-year-old Alexandria died in a Tyler hospital at around 2 this morning.

9-year-old Cynthia is at the Childrens Medical Hospital in Dallas - in stable - but criticial condition.

UPDATE (10:49 AM, Saturday)- KLTV 7 has learned 33 year old, Jesus Soto has an ICE hold placed on him by U.S. Immigration and Customs Enforcement. There is no bond available to him as a result of this immigration (ICE) hold. TYLER, TX (KLTV) - A 12 year old girl died early this morning, hours after a car crash in Tyler. The driver of the car she was in has been charged with Intoxicated Manslaughter as a result.

TYLER, TX (KLTV) - The wreck happened shortly after 9:00 PM at the intersection of W. Gentry and N. Bois D'Arc. Tyler Police say 33 year old, Jesus Soto was eastbound on Gentry and attempted to turn north onto Bois D'Arc. His Chevy Corsica with two little girls as passengers turned into the path of a white Ford F-150 that was westbound on Gentry. The Corsica was badly damaged in the collision. Officers say they became concerned that Soto was intoxicated and he was taken to a local hospital for his injuries and to have a blood sample taken. The four people in the Ford complained of minor injuries, but the injuries to the girls in the Chevy were much worse.

Twelve year old, Alexandria Castillo died around 2:00 AM today from her injuries. Nine year old Cynthia Daneilla was flown to Dallas Children's Hospital where she is listed in critical, but stable condition.

Jesus Soto was arrested and booked into the Smith County Jail on one count of Intoxicated Manslaughter and one count of Intoxicated Assault.
