    Bush Pardons Turkeys but NOT Border Patrol Agents!

    Dear CFIF Member:

    Question: With thousands of illegal aliens -- many of whom are drug smugglers, gangsters and other criminals -- crossing our borders every single day, what happens to our brave border patrol agents who aggressively pursue and try to capture these criminals?

    Answer: 11-12 years in prison!

    These days you hear a lot in the mainstream media about Nancy Pelosi and Hillary Clinton and Britney Spears and OJ Simpson. But unfortunately you hear nothing about Jose Alonso Compean and Ignacio Ramos.

    Compean and Ramos are the two U.S. Border Patrol agents recently sentenced to a combined 23 years in prison for defending our borders against illegal alien drug smugglers.

    To refresh your memory, here are the bare facts of the case:

    On February 17, Border Agents Compean and Ramos - both loyal Americans of Mexican descent -- spotted a drug smuggler's van near the Rio Grande.

    The van contained 743 pounds of marijuana and was driven by an illegal alien named Osbaldo Aldrete-Davila.

    When the illegal drug smuggler saw Agents Ramos and Compean, he ran for the border.

    Agent Ramos and another agent chased the drug smuggler.

    According to media reports, Aldrete-Davila at one point turned toward the pursuing agents and pointed what appeared to be a gun. At least one of the agents then fired his weapon at the fleeing illegal alien drug smuggler.

    The fleeing drug smuggler Aldrete-Davila was hit in his buttocks -- although Agents Compean and Ramos apparently did not know it at the time -- and Aldrete-Davila didn't even slow down. He jumped into a waiting van and sped off in the night.

    And would you believe that these brave border patrol agents are now headed to jail for a combined 23 years for what Congressman Tom Tancredo described as "doing their job?"

    What happened to Aldrete-Davila? The drug smuggler received full immunity for his crimes in return for his testimony against Compean and Ramos. Not only that, he was given full medical care at an Army medical center in El Paso courtesy of U.S. taxpayers.

    And according to Congressman Ted Poe (R-TX), who served as a prosecutor for 8 years and a judge for 22 years before being elected to Congress, "While waiting free to testify, Aldrete-Davila was arrested again for drug smuggling and once again given immunity from the prosecutor."

    This is a tragedy of justice that sends the wrong message to our border patrol agents who put their lives on the line each and every day.

    Congressman Poe went on to say, "The government's aggressive prosecution has further diminished any faith law enforcement has in them and the American public's trust in their ability to secure our borders."

    We must make our voices hear right hear and right now. We must demand that President Bush use his power to pardon Agents Ramos and Compean immediately!

    Were These Border Agents Renegades?

    Here are a few facts about Border Agents Compean and Ramos:

    Ramos served 7 years in the U.S. Navy before joining the Border Patrol. Compean served 4 years in the Navy.

    In 2005, Ramos was nominated for "Border Patrol Agent of The Year."

    Ramos and Compean have a combined 15-year record of sterling service on the Border Patrol (10 years for Ramos and 5 years for Compean).

    The two agents have arrested thousands of illegal aliens and made more than 100 drug seizures.

    According to Andy Ramirez, Chairman of Friends of the Border Patrol, "There's nothing in [Ramos and Compean's] records to support Davila's charges that they tried to murder him. If you take away the testimony of Davila, an acknowledged career criminal with a huge financial interest involved, all you have against these agents are a couple of administrative charges that would normally be five to ten-day suspensions, usually referred to as 'time on the beach.'"

    So what is happening here?

    Why did Johnny Sutton -- U.S. Attorney for the Western District of Texas -- charge these two heroes with Causing Serious Bodily Injury, Assault with a Deadly Weapon, Discharge of a Firearm in Relation to a Crime of Violence, and -- get this -- a violation of the "civil rights" of an illegal alien?

    Why did he throw the book at these two men with stellar records serving their country?

    Your guess is as good as ours.

    Here's how Congressman Poe put it:

    "In my opinion, the government is on the wrong side. We ought to be more concerned about our border agents who were put in harm's way... than we are about the civil rights of drug smugglers... In a United States court of law, an illegal drug smuggler's word was given more credibility than that of two American citizens who have sworn to enforce and uphold our laws.

    "As a former judge, I do not believe that anyone, including law enforcement is above the law. However, I also do not believe that it is in the best interest of the law to place the credibility of a drug smuggling illegal who attacked and ran from the law above the testimony of sworn law enforcement officers.

    "What is to become of our country when our own government takes sides with illegals?"

    An Overzealous Prosecutor

    At the trial, the prosecutor answered Ramos's testimony that he saw "something shiny" in Davila's hand: by saying that he "couldn't be sure it was a gun he had seen." So he shouldn't have fired.

    In other words, if it's dark and you can't be absolutely certain that what you see is a pistol, don't shoot until you get a bullet between your eyes. Then you can be confident that you won't be illegally wounding some drug dealer in the posterior.

    The prosecutor also said agents were not allowed to pursue dope dealers on the run. As she put it: "Agents are not allowed to pursue. In order to exceed the speed limit you have to get supervisor approval, and they did not."

    If you needed proof positive that the powers that be aren't serious about controlling our borders, then there's your smoking gun -- Border Patrol regulations that guarantee failure.

    Ramos, who had a stellar 10-year record and who had been nominated for the Agent of the Year award, said in reply:

    "How are we supposed to follow the Border patrol strategy of apprehending terrorists or drug smugglers if we aren't supposed to pursue fleeing people? Everybody who's breaking the law flees from us. What are we supposed to do? Do they want us to catch them or not?"

    The answer to Officer Ramos's question is: "OBVIOUSLY NOT!"

    What are Others Saying?

    People all over the country have expressed their indignation at this sickening misuse of our judicial system, which further hamstrings and intimidates our Border Patrol.

    Tom Tancredo -- Congressman, anti-illegal immigration activist, and author of In Mortal Danger -- said: "This is not the message that our legal system should be giving to the drug cartels that are smuggling drugs, people and terrorists across our borders."

    Andy Ramirez, of the non-profit Friends of the Border Patrol, said: "This is the greatest miscarriage of justice I have ever seen. This drug smuggler has fully contributed to the destruction of two brave agents and their families and has sent a very loud message to the other Border Patrol agents: If you confront a smuggler, this is what will happen to you." [Emphasis Mine]

    Twelve members of Congress have already sent a letter to President Bush, in which they said in part: "We ask that a full investigation of this case be ordered immediately. We are confident that during such an investigation you will find that these Border Patrol agents were acting within the scope of their duty and were unjustly prosecuted. Also, we ask that you use your power of presidential pardon, as granted by the United States Constitution in Article II, Section 2, to pardon these two Border Patrol agents."

    These expressions of outrage and anguish underline the monumental importance of this case.

    The drug cartels, gangs, and even terrorists seeking to exploit our nation's open borders have just seen the light turn green. The Border Patrol has been stripped naked. It can't fire a gun without risking more than ten years in prison. It can't violate the speed limit without saying, "Mother, may I?" And if it detains an illegal alien dealing drugs, it may be violating his civil rights.

    If you think illegal immigration is a problem, wait till you see what happens after Compean and Ramos are hauled off to prison in chains.

    And what about Osbaldo Aldrete-Davila?

    He'll be back. (He's probably back already): selling drugs to America's children and grandchildren, thumbing his nose at Homeland Security -- a hero to all his drug smuggling and criminal friends back home, where he is hailed as the smuggler who disarmed the U.S. Border Patrol.

    And next time he'll bring more just like him -- all of them gleefully gloating over the knowledge that this country doesn't have the will to close its own borders.

    American Voters Are Serious About Border Security!

    The case involving Agents Ramos and Compean is precisely what led the GOP to lose the House and Senate.

    Time and time again, the American people demanded border security from Congress. But time and time again, instead of strengthening our border security and enforcing the laws on the books, Congress presented proposals to grant Amnesty to millions of illegal aliens already in our country.

    Gain pardons for Compean and Ramos and we tell the world we're serious about securing the border.

    Let these sentences stand, and the illegal immigration advocates in both parties win another big one.

    Pardoning these two persecuted border agents - giving them the justice they were denied in a federal courtroom - would go along way toward sending the right message to the voters.

    It's not just on the internet, I run into people all the time that still have their heads in the sand. Granted it's getting fewer and far between, but they are still out there. In fact yesterday I ran into some dimwitted Bushbot lady (she has to be some whackjob from the religious right) that firmly believes that we are in Iraq to do God's work (all this despite the fact that no one religion and it's leaders have come out to claim this so called revelation).

    Believe me, some people are still brainwashed idiots.
