    Constitutional Convention update

I received this message regarding a Constitutional Convention:

the Constitution guarantees that when 3/4 of the states request a Constitutional Convention, Congress is required to call for one . . .
"check out the federal lawsuit currently being adjudicated over at the u.s. ninth circuit court of appeals.

called Walker V. Members of Congress, it will force the courts to decide this: does congress have to obey the constituion or not?

there are now over five hundred applications from ALL FIFTY STATES currently in the office of the secretary of congress and they have failed to put out the call for a national convention"

the website with all the info and pdf files of the case are found at http://www.article5.org

another site with the same idea is http://www.cc2.com

Power To The People has brought its lawsuits because the Constitution is NEVER optional.

Power To The People has sued the United States Government and Members of Congress in two separate lawsuits in order to regain amendatory control of the Constitution using an Amendment Convention. An Amendment Convention will re-establish this heritage by giving back amendatory control to the people via constitutional provisions, while providing a balance of power to the national government that is sorely lacking.

"The district court has ruled the Congress has the authority to decide if it will obey a clause of the Constitution, giving that body--and presumably every citizen--the power to veto any clause of the Constitution they disagree with."

July 8, 2005: Power To The People today received electronic notice that the clerk for the United States District Court for Western Washington had "transmitted to the US Court of Appeals...the clerk's record on appeal (case full electronic)". This transmission is one of the procedural steps the appeals court requires before the suit is submitted to a merits panel for consideration. It allows the panel to examine the full record of the proceeding rather than just whatever material is presented in briefs by the parties.

I guess Congress forgot it's oath to "defend the Constitution" -- and exactly where does the Constitution give Congress the power to "choose" which provisions it will obey?

    Congress refuses to "repel invasion"
Congress taxes the American people to support aliens
Congress grants amnesty to aliens in violation of the Constitution
Congress transfers the powers delegated to it in violation of the Constitution
Congress passes "bills of attainder" in violation of the Constitution
Congress, through its collection agency the IRS, issues "bills of attainder" that work the "corruption of blood" -- where private property is passed from one generation to the next
Congress passes "commerce" legislation that cost the American people their jobs and their homes

I might add that the reason Congress refuses the states the right to call for a convention and amend the Constitution is for two reasons:

    1. the States don't have a representative in Congress to guarantee their Constitutional rights

    2. the states can repeal the 17th amendment
