"1. No jurisdiction
2. No standing
3. No injury
4. Try on the merits. "
Every days news on all issues that I can try to keep up with just reinforces to me that the federal government is making itself more and more irrelevant to the citizens who support it with their monies. Not just irrelevant but life-threateningly dangerous. I think this whole issue and lawsuit is waking citizens up - just what we need if we want to correct the problems. You know, I am an ignoramus. Has the federal government ever sued a state before? To me it is so shocking, so stupid, so lacking in leadership, so stupid . . . . and did I say . . . . so stupid?Restitution to Displaced Citizens First!

"So if Sheriff Joe or whoever hands over a dangerous illegal, that was snared in a sweep or traffic stop, and thus the Feds don't have to send out a SWAT team to 5 different addresses to try and apprehend the guy, that is a "burden to the feds"? The local police will be doing a lot of their work and that is a burden to them??? ROTHFLMAO. "
That's what I've been saying all along! We made a law that supports the feds in doing their job and all they can do is bitch and gripe and complain, cast nasty aspersions against us, and all else failing - take us to court for helping them? Who knew? Or are they complaining that there are so many illegals that they are too understaffed to handle the job? Well, all the more reason to bring our boys and girls home where they are needed most.Restitution to Displaced Citizens First!

I have a feeling that this case may not be in court very long.

Eric Holder's big lie!
The big lie, which Eric Holder along with our progressive media is now promoting is, the federal government has supreme authority to deal with those who have invaded our borders, and Holder points to Article VI, clause 2 of the Constitution which declares:
[b][i]“This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.â€

court case
I would note that, although the Constitution enumerates what Congress may do, years of cases have defined the meaning, so a straight reading of the Constitution without case law doesn't always seal the argument.
A lawyer on TV (sorry, I can't remember for certain, though I think it was Fox) said there was a Supreme Court case that established that, when the Federal government fails to enforce a law, the states may then enforce that law. This could be part of the defense for AZ, though now the Feds could argue they are acting.
Nevertheless, the approach of the administration is appalling and clearly politically motivated.“Claiming nobody is listening to your phone calls is irrelevant – computers do and they are not being destroyed afterwards. Why build a storage facility for stuff nobody listens to?.” Martin Armstrong
