FBI Says Forest Park Shooting Victim Pointed Gun

Reported by: Becky Freemal, Bill Price

    --------------------------------------------------------------------------------
Update @ 4:34 p.m. by Reporter Bill Price:
The Cincinnati FBI office nows says that 30-year-old Gerardo Mulato of Forest Park pulled a 9-millimeter Ruger pistol out and pointed it at them, during a drug surveillance opeation at his Waycross Road apartment complex. Mulato was struck in the midsection and later died of his wounds.

The incident happened at the Waycross Apartments, at 1995 Waycross Road, near Sebring at about 4:30 a.m. Thursday morning. When Mulato apparently spotted the agents and drew his weapon, that's when one of the five FBI agents on the operation, fired a single shot, striking Mulato.

Mulato reportedly died as an ambulance arrived on the scene. An autopsy by the Hamilton County Coroner's Office says Mulato died from a perforated artery in his abdomen caused by the gunshot.

A loaded 9 mm Ruger was found next to Mulato at the scene of the shooting.

No FBI or local law enforcement officers were injured in the shooting. The FBI says its investigation is now continuing, with assistance of investigators from Washington, D.C.

The FBI says agents are allowed to use deadly force against an individual, when an agent reasonably believes the subject constitutes the imminent danger of death or serious physical injury to the agent or to others.

Update @ 2:02 p.m. Thursday by Reporter Bill Price:

FBI agents and local law enforcement have gathered around a black Mercedes sedan in the parking lot of 1995 Waycross Road in Forest Park, where 30-year old Gerardo Mulato was reportedly shot-to-death this morning by an FBI agent.

We've seen a crowd of law enforcement personnel around the sedan's trunk, with one agent, wearing blue latex gloves, emptying out the contents of the trunk. We're being kept at a distance, so we can't make out what they are taking out of the trunk.

At this hour, we're still waiting for FBI crime investigation teams to arrive here in Forext Park to continue the federal side of this FBI shooting investigation. Over a dozen police and FBI agents remain on scene, with significant portions of the parking lot and surrounding areas at the Waycross Apartments, still cordoned off by yellow police crime scene tape.

More updates here as they become available.

    Update @ 1:37 p.m.:

Michael Brooks, with the FBI says, "In these incidences, the FBI will dispatch a team of inspectors from our headquarters in Washington, which will be in charge of the FBI side of the investigation." The team is expected to arrive in Forest Park Thursday afternoon.

The victim of the shooting has been identified as Gerardo Mulato.

The details of the FBI operation haven't yet been released.
