EL PASO - Former U.S. Border Patrol agent Jose Compean, who was sentenced to 10 years in prison two years ago after being found guilty of assault with a deadly weapon, was re-sentenced on Wednesday to the exact same term.

EL PASO, Texas (AP) - A former Border Patrol agent convicted of shooting a fleeing drug smuggler will serve his original 12-year prison sentence.
An El Paso judge resentenced Jose Alonso Compean Wednesday to 10 years in prison for his conviction on a charge of using a weapon in the commission of a felony and another two years for assault and other charges, the U.S. Attorney's Office said.
Compean's sentence was reissued because the 5th Circuit U.S. Court of Appeals early this year tossed out convictions for tampering with an official proceeding. The appeals court upheld the majority of the convictions, including the weapons charge that brought a mandatory 10-year term.

EL PASO, Texas (AP) - A federal judge in El Paso today resentenced a now-former Border Patrol agent to his original 12-year term over a 2005 shooting.
Jose Alonso Compean was convicted of shooting a fleeing drug smuggler.
Another former agent will be resentenced tomorrow.
Meanwhile, lawyers for Compean say they're asking the U.S. Supreme Court to review the case.
The judge resentenced Compean to ten years for using a weapon in the commission of a felony, and another two years for assault and other charges.
Compean and now-ex agent Ignacio Ramos was convicted in 2006 of shooting admitted and now convicted drug smuggler Osvaldo Adlrete Davila and trying to cover it up.
A federal appeals court this year threw out some convictions against both former lawmen -- but upheld the majority of the case.
Several members of Congress, including Texan Ted Poe, have asked President Bush to pardon the former agents -- or at least commute their sentences.
Both ex-agents have been in prison since early 2007

This is America? No. Not the America I remember.
That is about as insane as it gets. This DAM illegal alien thing is beyond the twilight zone.
The illegal President elect will never let them out of confinement! It might offend his friends the illegal alien criminals.
