A former Border Patrol agent's lengthy sentence for shooting a fleeing drug smuggler had been described as extreme by his supporters, but a federal judge showed no mercy Wednesday at the former agent's resentencing hearing in El Paso, Texas.

The judge upheld Jose Alonso Compean's original punishment and resentenced him to 10 years in prison for his conviction on a charge of using a weapon in the commission of a felony and another two years in prison for assault and other charges, the U.S. Attorney's Office said.

Compean's attorneys plan to turn to the Supreme Court for a review of the case. Bob Baskett, an attorney for Compean, did not immediately return a call for comment from FOXNews.com.

Compean, along with former agent Ignacio Ramos, was convicted in 2006 of shooting Osvaldo Adlrete Davila — an admitted, and now convicted, drug smuggler — and trying to cover up the shooting.

The 5th Circuit U.S. Court of Appeals in New Orleans threw out some convictions against Ramos and Compean earlier this year, prompting Wednesday's new sentencing hearing. But the court upheld the majority of the case, including the weapons charge that brought a mandatory 10-year prison term.

"The simple truth of this case is that former Agents Compean and Ramos shot 15 times at an unarmed man who was running away from them and posed no threat," U.S. Attorney Johnny Sutton said in a statement released following the 5th Circuit's September ruling. "They lied about what happened, covered up the shooting, and then proceeded to write up and file a false report."

Both men have been in prison since January 2007. Ramos, who originally was sentenced to 11 years and a day in prison, is scheduled to be resentenced in federal court in El Paso on Thursday.

The case against Compean and Ramos prompted a massive outcry from supporters of the former agents who argued that Sutton should have focused his office's efforts on prosecuting illegal immigrant Osvaldo Aldrete Davila for his drug-smuggling activities.

Several members of Congress, including Rep. Ted Poe, have asked President Bush to pardon the former agents, or at least commute their sentences.

"He's certainly still asking the president to consider this in his traditional end-of-term pardoning," said Deeann Thigpen, a spokeswoman for Poe, a Texas Republican.

U.S. presidents traditionally issue pardons and sentence commutations in the final days in office. So far, though, Bush has not indicated whether he's considering acting on the agents' requests, Thigpen said.

In January 2007, then-White House spokesman Tony Snow indicated that the Oval Office seemed to be in agreement with federal prosecutors.

"The facts of this case are such that I would invite everybody to take a full look at the documented record," Snow said then. "This is not the case of the United States saying, 'We are not going to support people who go after drug dealers.' Of course, we are. We think it's incumbent to go after drug dealers, and we also think that it's vitally important to make sure that we provide border security so our people are secure.

"We also believe that the people who are working to secure that border themselves obey the law."

Aldrete, who admitted smuggling several hundred pounds of marijuana on the day he was shot in 2005, pleaded guilty earlier this year to drug charges related to two smuggling attempts several months after he was shot in the buttocks while running away from Ramos and Compean. The same federal judge who sentenced the former agents ordered Aldrete to serve 9 1/2 years in prison.

Ramos and Compean argued during their trials that they shot Aldrete, whom they believed was armed, in self defense. Aldrete has denied having a weapon the day he was shot.

Compean told FOXNews.com last January that his family had "lost everything."

    Compean & Ramos

Its official now if it was not before. Ramos & Compean are true "political prisoners." They are pawns in a convoluted political dynamic meant to legalize an illegal population so corporations can employ cheap labor. In addition, knowing legalization will mean an end to cheap labor since they will then be able to use the legal system for protections... it is obvious the lack of serious southern border protection is to allow in the vast numbers of new illegals who will follow thinking they too will one day be legalized into an America that will provide them with all they want, for free. The new illegal aliens will replace the old illegal aliens as the underground employee workforce to be exploited by greedy profiteering employers. So, one batch will simply replace the other. In the meantime, the American workplace will be glutted with an excessive workforce that all employers will be able to exploit. And that will include citizens as they compete for the few jobs there are, against all too willing illegal aliens who will accept almost any pay rate, forcing citizens to do the same. The standard of living of average Americans will quickly deteriorate to third world levels, as the greedy & politically connected, profit handsomely.
Many illegals are willing to work. Many illegals will work hard & at jobs most of us do not want, at the low pay scales employers are paying.
The issue still has nothing at all to do with willingness to work or what jobs are done. In fact, there are two issues & they remain the law, and money or profits.
Are we a nation of laws, or are we a nation that disingenuously says one thing while doing almost exactly the opposite. All just so the greedy & corrupt can collect excessive profits. Not just large corporations either. There are plenty of small businesses that use (read: abuse), illegal alien labor. And, so long as we do not stop the flow, there will be the greedy profiteers who will exploit labor & skirt our laws, all the while mocking those of us who protest..... as racists & bigots, while the employers & politicians are the ones who are displaying obvious racial bias & employing abusive tactics against those of different color or nationality.
We already know amnesty or legalization does not work. The many previous attempts have documented that. We already know if we do this, millions more will follow looking for "the next amnesty." This was the case since all previous amnesties. Although after this one, the numbers will overwhelm all of us. We already know that along with the hard workers, we get criminals aliens by the truckloads. Criminals aliens who have killed more Americans since 9/11, than have been killed in Iraq & Afghanistan combined, plus some.
The last number of deaths that can be traced to illegal aliens that I remember reading, was over 69,000. If we had lost that many soldiers in Iraq &/or Afghanistan, then the media would have really had something to talk & rave about. But, the media mentions almost nothing of the thousands of innocents deaths committed by or attributable to, illegal aliens.
And despite all of this, almost no one is talking about the illegal alien criminal child molesters who are also among those here illegally. And no one is discussing the permanent psychological damages done to those children by those illegal alien criminals. Nor is there much talk in the mainstream media about the identity thieves who have ruined the financial lives of thousands of Americans & stole their wealth while doing so, or the gang units that have virtually taken over entire regions of many major western cities. There are police "no-go alien zones" in Los Angeles. Yet the illegal alien sympathetic media, says almost nothing, but they always highlight the difficulties of illegal aliens. Once again, to protest illegal aliens is simply another stone used to throw at Americans, as the only evil of the world. Its all "our" fault. No one else has any responsibility or blame. We are portrayed as the selfish & mean spirited!
Compean & Ramos did their jobs. They made "procedural errors. BUT, not one of those errors can possibly justify the excessively harsh criminal prosecutions these men & their families now endure. If only all of those weeping international human rights groups would look into this travesty!?! Yeah, right!
Compean & Ramos were convicted of crimes using a law never intended to criminalize the use of a gun by an officer of the law who was in the performance of their duty. To accuse them of such, one must assume they approached that night & that situation, with deliberate intent to commit a crime. We all know that not to be the case. That courts have upheld this, makes a mockery of our entire judicial system. It permits prosecutors to use any law, any time, for any incident, to prosecute anyone as viciously as that prosecutor or the political system desires, with no reasonable check or balance. In short, it allows the system to politically prosecute, under the guise of justice.
Bush & those who have him by the ear, have had their way for too long. However, if we thought he was bad, wait. Because under an Obama administration, we will see legalization or amnesty, plus a lot more, as Democrats work hard to increase their voter rolls of thankful aliens, who broke our laws, yet will be rewarded with citizenship & benefits. Democrats are planning to use this new voting block to maintain their hold on power for decades to come. If that block actually votes according to logic or typical Hispanic conservative principles, it will surprise us all, but mostly Democrats.
No matter what, Obama will not free these two political prisoners & in allowing them to languish in prison, the message to all other Border Patrol Agents is, "shut up, keep your head down, look the other way, make no waves, and always-always-always.... aim high & miss!"
God help us.... it seems no one on earth is!

The families of these border agent/political prisoners are struggling. Homes are in jeopardy, lives torn apart. So, we’re raising money for Monica Ramos and Patty Compean.

We’re asking that instead of one check, split your donation between the two: Make them out separately to Monica Ramos…AND…Patty Compean…and mail to:
