    Federal OK required for new toll highways

    Experts say guidelines for approval may not include property tax relief.

    TRENTON -- An idea to convert some of New Jersey's interstate and state highways to toll roads to generate money for property tax relief may face a speed bump.

    Federal highway regulations say that if such a conversion is made, the money has to be used for transportation and requires Federal Highway Administration permission, which only is granted under certain circumstances.

    Experts said that collecting tolls and using that money to offset property taxes hasn't been done in other states, and they doubted such a plan would get federal approval.

    "To go directly to property tax relief is a reach, the (thing) they (federal officials) visualize is to keep it in the transportation vein," said Neil Grey, government affairs director of the International Bridge, Tunnel and Turnpike Association. "There is no precedent."

    The idea of creating new toll roads on existing highways was among the revenue-raising ideas examined in a Nov. 15 report for the state by UBS Investment Bank.

    That report ranked creation of new toll facilities to be "very viable." However, it cautioned that there could be "heightened construction risk from those assets needing extensive capital investment."

    Potential new toll roads suggested include Interstates 78, 80 and 95, in addition to state Route 440.

    State Department of Transportation Commissioner Kris Kolluri said the idea is worth studying to get data for long-range planning. Transportation advocates say it's a way to fund reconstruction of those roads and to finance the state Transportation Trust Fund when it runs out of money in four years.

    Since 1995, federal highway laws have relaxed past prohibitions on collecting tolls on interstate highways. Even with the most recent revision in August 2005, however, the circumstances for converting interstate highways to toll roads are limited.

    "There is language that says for a bridge or tunnel on the interstate system, that if the state rebuilds it, they can bring it back as a toll facility," Grey said.

    The 2005 legislation also allows use of tolls as a pilot program on up to three existing interstate facilities nationally, such as a highway, bridge or tunnel. It permits tolls to be used to fund needed reconstruction or rehabilitation on interstate highway corridors, which couldn't be adequately maintained or improved without the collection of tolls.

    Each of those scenarios requires the state to apply to the Federal Highway Administration for approval, starting with filing an "Expression of Interest."

    No application has been filed by New Jersey, and because of that, highway administration officials had no further comment on the concept, spokeswoman Nancy Singer said.

    In such a case, federal officials generally expect that toll revenues are used for transportation, Grey said. The imposition of tolls also means that federal funds may not be spent on that road, bridge or tunnel, he said.

    "Those are questions we have to ask. Part of the review requires us to look at (federal) transportation law," Kolluri said. "That is the next step."

    I have a problem with them "re-tolling" a road. When the road was built, it did not exist so the current commuters were not dependent on the road. In other words, the people using the toll road had a choice.

    However, re-tolling is exploiting people that are dependent on the road. They do not have a choice. They must travel these roads, to get to work or transport goods.

    I guess our government has spent so much money on the Wars in Iraq that they can't even afford infastructure anymore. I guess the Bush's didn't consider that when they waged war. How can you see such things with that much oil in your eyes.

    I HAVE A PROBLEM RE-TOLLING A ROAD TOO...BUT THIS IS A SHAM...WHEN THESE BILLS WERE PASSED IT WAS FOR THE RESTRUCTORING OF THE WHOLE COUNTRIE'S INFRASTRUCTURE TO MAKE US INTERNATIONALLY TRUCKING FROM MEXICO THRU US TO CANADA...SO THEY HAVE TO MAKE EXCUSES AND GIVE REASONS SO THEY CAN TOLL THESE ROADS WHICH ARE FOR THAT NAFTA PROGRAM AND MAKE MONEY WHILE THEY ARE AT IT......

    NJ IS SO CORRUPTED AND OVERTAXED, PEOPLE BARELY MAKE IT THERE,
    SO MANY CROOKS GET MONEY FROM THE HARD WORKING PEOPLE, JUST BECAUSE THEY ARE CONNECTED, NOW THEY WANT TO MAKE RT 80 A TOLL ROAD, IT'S A TRAVESTY, THANK GOD I MOVED THE HELL OUT OF THERE!!!!

    Delaware is also beginning a new toll road (rt 301)! Do you have any maps of the "new" toll roads in NJ? We really need to connect the dots as these roads must link to each other at state lines.

    Every time you come across the term "Public-Private Partnerships" or "Stakeholders" your ears should prick up because those are the new catch phases for lucarative investment deals for the wealthy. In addition to connecting the 3 countries, these highways are going to add millions and million to the investment portfolios of "in the know" elitists (many of which, undoubtedly, legislated these laws) in this increasingly agressive push to shake down lower and middle income Americans.

    LISA SYLVESTER, CNN CORRESPONDENT ( Washington is notorious for budgetary magic tricks, but this one might take the cake. How do you hide $8.5 billion? That's what some critics say happened with the highway bill Congress approved last week.

    PILGRIM: More now on the massive nearly $300 billion transportation bill just passed by Congress. Critics say Congress won White House support for the pork-laden bill using questionable tactics. They call it a classic case of highway robbery.
    Plus, "Highway Robbery". An incredible accounting trick in Washington. How $8.5 billion in pork can simply disappear. We'll have a special report.

    SYLVESTER: The budget trick is called a rescission. It's tucked in the highway bill that authorizes money for roads, transit and infrastructure projects. Congress promises states $295 billion to spend on transportation projects. But the states are supposed to only spend $286.5 billion, and on the very last day the bill is in effect, return any money left over. Kind of like raiding the cookie jar.
    The bill's advertised price tag, $286.4 billion. But critics say the real price with when all is said and done will be $295 billion.

    SYLVESTER: The Department of Transportation defends the use of the rescission, saying it gives states the flexibility to pull back funds from one transportation program to fund another project.

    SYLVESTER: Fiscal conservatives are urging President Bush to follow through on a promise to veto any bill that closes in on $300 billion, but the president has indicated he will sign the bill.
