    Presidential Impeachment:

    Past due: Time to make our case, this Dictator POTUS is Out of Control!
    The involuntary removal of a sitting President of the United States has never occurred in our history. The only legal way such can be accomplished is by the impeachment process. This article discusses the legal standard to be properly applied by members of the United States House of Representatives when voting for or against Articles of Impeachment, and members of the United States Senate when voting whether or not to convict and remove from office a President of the United States, as well as the procedure to be followed.
    Article I § 2 of the United States Constitution gives the House of Representatives the sole power to impeach (make formal charges against) and Article I § 3 gives the Senate the sole power to try impeachments. Article II § 4 of the Constitution provides as follows:
    "The President, Vice President and all civil officers of the United States, shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors." (Emphasis supplied).
    Thus, the operative legal standard to apply to an impeachment of a sitting President is "treason, bribery, or other high crimes and misdemeanors." There is substantial difference of opinion over the interpretation of these words.
    There are essentially four schools of thought concerning the meaning of these words, although there are innumerable subsets within those four categories. The first general school of thought is that the standard enunciated by the Constitution is subject entirely to whatever interpretation Congress collectively wishes to make:

    Rep. Tim Scott (R-Ga.) said on July 5 that if President Obama should invoke a clause in the 14th Amendment of the U.S. Constitution in order to bypass Congress and borrow beyond the debt limit, he would consider that an act worthy of impeachment. "This President is looking to usurp Congressional oversight to find a way to get it done without us. My position is that is an impeachable act from my perspective," Scott said at a Tea Party-related meeting. Rep. Pete Olson (R-Tex.) later told an interviewer that Scott's "is not a lonely voice," and that others are also discussing impeachment.
    What Obama and Treasury Secretary Tim Geithner are in fact doing, is using the threat of default, or of preventing default by using Clause 4 of the 14th Amendment, in order to protect London's and Wall Street's illegitimate debt. Obama and Treasury Secretary Timothy Geithner have done everything in their power to oppose the Constitutional method of dealing with the debt—the restoration of Glass-Steagall—and are instead using the threat of default to ram through killer austerity, in violation of the Constitution's commitment to the general welfare.
    This is but the latest in a long series of impeachable offenses committed by Obama:
    * Most recent is his flagrant violation of the U.S. Constitution and the War Powers Resolution by deploying U.S. armed forces and conducting war against Libya without Congressional authorization or a declaration of war. Indeed, Obama has insisted that a United Nations resolution authorizing "humanitarian intervention" is a higher authority than the United States Constitution.
    * Already in April 2009, Obama was engaging in actions to destroy the sovereignty of the United States, when, at the London G20 meeting, he agreed to actions, including the expansion of "Special Drawing Rights," which gave the International Monetary Fund increased power over the economy of the United States and other sovereign nations.
    * Obama's shutdown and destruction of the NASA manned space flight program, on behalf of the British, was what triggered Lyndon LaRouche's first formal call for the impeachment of Obama, in February 2010.
    * Obama's health-care plan, modeled on Hitler's T-4 policy, in its scheme to deny medical care and treatment to certain categories of people, constitutes a crime against humanity under the Nuremberg Principles to which the United States is bound by law and treaty.
    * Obama's violation of the separation of powers, by means of unilateral executive actions, in violation of U.S. law including treaty law, has exceeded even that of George W. Bush and Cheney in many respects.
    * He has continued the use of signing statements, and has made dozens of appointments of special "czars" and recess appointments, to circumvent Congressional oversight and the Senate confirmation process.
    * He has expanded domestic surveillance and wiretapping, has continued the use of abusive detentions and interrogations of prisoners taken in the "war on terror," and he has expanded the use of targeted assassinations, including claiming the right to kill American citizens abroad without any due process.
    * He has effectively legalized torture and prisoner abuse in violation of U.S. law and treaty obligations, by directing his Justice Department to cover up hundreds of cases of abuse and torture and even deaths, from the Bush-Cheney years.

    Constitution: President Obama's nonrecess "recess appointments" can't be excused as over-the-top electioneering. This president has crossed over from socialistic extremism into lawlessness and, perhaps, impeachability.
    The U.S. Constitution established a strong presidency — so strong that even one of the most esteemed founding fathers, Patrick Henry, worried it would be kinglike. But this week saw a president exceed even those broad constitutional powers because doing so fits his election-year narrative of a "do-nothing Congress" so well.
    Now we have the makings of a banana republic, where the rule of clearly written constitutional law is compromised by a ruler's subjective whim.
    The Constitution is crystal clear on the recess appointment authority of the president.
    "The president shall have power," Article II, section 2 states, "to fill up all vacancies that may happen during the recess of the Senate, by granting commissions which shall expire at the end of their next session."
    The Senate has not been in recess. And Congress' authority over when it is and isn't in recess is no small matter of parliamentary procedure. Rather, it is a power the Framers explicitly bestowed in Article I, Section 5:
    "Neither House, during the session of Congress, shall, without the consent of the other, adjourn for more than three days."
    Yet Obama on Wednesday, with no recess in effect and against the publicly stated position of his own Justice Department, made four "recess appointments."

    Former Ohio attorney general Richard Cordray was named head of the Consumer Financial Protection Bureau — a new, intrusive federal agency established last year by the Dodd-Frank law — and three spots on the National Labor Relations Board were filled.
    The GOP-majority House has been keeping Congress in session, using its lawful power to prevent Obama from steamrolling someone into the CFPB position outside the usual Senate confirmation process because, as House Speaker John Boehner explained Wednesday, "the agency it heads is bad for jobs and bad for the economy."
    Some may say these are small-potato government jobs not worth a big confrontation. But if a president can trample the Constitution on these appointments, the door opens for similar abuses of power with Cabinet secretaries and judicial nominations.
    As Boehner warned, "The precedent that would be set by this cavalier action would have a devastating effect on the checks and balances that are enshrined in our Constitution."
    Senate Majority Leader Harry Reid, D-Nev., until recently agreed with the Obama and Clinton Justice Departments — and with just about every other legal expert, liberal, conservative and middle of the road — that presidents have to wait for Congress to be out of session three days before legally making a recess appointment.

    Whether or not any of these troubling examples will lead to Obama’s impeachment and/or imprisonment, only time will tell. Regardless, taken together they paint a picture of an out of control President who lacks basic American values and has little to no respect for the rule of law.
