All Congress has to do it pass a law and of course the President must sign it. The law would say that anyone born in the U. S. shall be a citizen only if at least one of the parents is a U. S. citizen or legal resident at the time of birth.

This is far simpler to do than amending the Constitution and it would preserve the 14th amendment. We need to protect the 14th amendment.
I think the only reason this Congress has not swiftly dealt with changing the law is they know it would be a waste of time. The Senate Dems would not pass such a law and Obama would veto it.

I'm hoping we can change this in 2012 election. We desperatly need to change the 14th.

I agree about not particularly wanting this Supreme Court to rule on it, but then what is your solution? (I frankly think open-borders, liberal activist judges of all positions, not just SC, are our worst enemy; even MORE so than the open-borders, liberal politicians.)

But I thought the only choice other than taking it to the Supreme Court, was basically to change the constitution, which would open up a whole new huge can of worms, that would be exploited by the Progressives and socialists. If we can get Congress to pass a law, and that would be enough, that would be great. I didn’t know about section 5 of the 14th Amendment that Justthatguy has posted. That might work. Of course, the open-borders lobby such as the ACLU will file suit like always to block it, trying to claim its in violation of the constitution, even though they know its NOT, its simply being misinterpreted and misapplied. (As if they really care a lot about the constitution.) They will find some liberal activist federal judge to block the new law, and it will likely end up having to go to the Supreme Court anyway.

I guess we could try passing a law, see what happens, then if it gets blocked, just go with changing the constitution.

But mostly we need to do something ASAP. Every year that goes by there are millions more anchor babies born -- millions more each year. This illegal invasion truly is an invasion-by-birth.

    Repeal the 14th Amendment

About every three months, the population of the US increases as much as the population of Tallahassee, FL. Who are these hundreds of thousands of new citizens? They are newborns, children of illegal aliens born in the United States – birthright citizens, “anchor babiesâ€

Each year, 500,000 to 700,000 anchor babies are born here and automatically recognized as American citizens. Only 30 of the world’s 194 nations confer automatic citizenship, and birth tourists – and just two are advanced economies – the US and Canada. No European country allows this. Such births surpassed 650,000 in the state of Texas alone.
When this author says "Each year, 500,000 to 700,000 anchor babies are born here", he/she is just talking about Texas, not the whole U.S. Because the author writes later in the same paragraph that "such births surpassed 650,000 in the state of Texas alone". I knew the total number of anchor babies each year in the U.S. is in the millions.

I've heard these numbers before, but they are truly mindboggling. That is 650,000 anchor babies in one state in one year. Most Americans really don't realize how bad this truly is.

fretsward - Good post. I like getting info about the history of the 14th amendment, and opinions about how we can change this misinterpretation and misapplication of the 14th amendment.

Do you have a source link for this article? Just FYI, ALIPAC usually requires the source be posted. Thanks.

Thank you builditnow. Currently, I'm in Norway. I'm remote accessing to my server. I have tons of info and archives. I recall the transcripts from that actual session. I'm surprised none of our politicians or those involved in revising this Amendment have not used this exchange. It was quite interesting. I will dig into my files in the morning.

    Thanks again.

Thanks fretsward. I save all info or articles I come across about the 14th amendment and resulting anchor baby explosion. Whenever you have time to post link is fine, I just would be hesitant to use info in it without source. Glad you're still posting from Norway!

Here is how the text of the law would read:
Anyone born in the U. S. is a citizen of the United States provided at least one parent is a citizen or legal resident. This law shall be exempt from judicial review.
