There is new information concerning a Harlan County rape case.
Police arrested Ismale Lopez, Marcos Lopez, and Gustabo Salinas and charged them with the rape and kidnapping of a 13 year-old girl.
"They were unable to produce any type of documentation, any type of legal documentation, no IDs," said Mike Nunley, Lynch Police Chief.
The men were picked up at a home in Gray's Knob, where the girl was also found.
Neighbors said there was a party at the home before police found the victim.
But now Ismale Lopez is out of jail. He apparently told authorities he was a juvenile.
We knocked on the door of the home Thursday, but nobody opened it.
The county attorney's office would not comment about anything concerning charges Ismale Lopez is still facing or why he would have been released.
Authorities plan to contact immigration services since they believe the three did not have any legal documents.
"To indicate who they were, if they were here legally or not, their ages, or anything," said Nunley.
Neighbors in the area said they are shocked and hope the community will get answers soon.
"They did not give any trouble as far as I know," said J.B. Engle, a neighbor.
The commonwealth's attorney's office would not comment on the case either.
It is the policy of WYMT-TV to not identify the name of rape victims.

3 men charged with raping Harlan juvenile

BENHAM, Ky. — Benham City Police Chief Drew Woods and Constable Jason Blanton walked Gustabo Salinas and Ismale Lopez into the Harlan County Detention Center on Wednesday after they were arrested for rape and other charges.
The Benham Police Department has been investigating the alleged kidnapping of a 13-year-old girl from Benham, who was found Tuesday night at Grays Knob. Three men have been arrested and lodged in the Harlan County Detention Center.
Lynch Police Chief Mike Nunley has been working jointly with Benham Police Chief Drew Woods with the investigation.
Nunley said Marcos Lopez, 23, of Cumberland, has been charged with first-degree rape, kidnapping (minor), first-degree unlawful imprisonment and false statements and concealment of facts prohibited.
Gustabo Salinas, 22, of Cumberland, is charged with first-degree rape, kidnapping (minor) and first-degree unlawful imprisonment.
Ismale Lopez, 27, of Grays Knob, is charged with first-degree rape and first-degree unlawful imprisonment.
The men were arrested and lodged in the Harlan County Detention just before 6 a.m.
According to the police citation, the girl was reported missing Monday night by her mother. Police said upon further investigation, and speaking with Marcos Lopez, the juvenile was found at a residence in Grays Knob late Tuesday night.
Police said after obtaining statements from the victim, it is alleged that Marcos Lopez took her by force from her residence in Benham and held her against her will. It is alleged that she was taken to a residence in Grays Knob where the three men physically and sexually assaulted her.
The girl was taken to Harlan ARH Hospital for treatment after the police located her.
The investigation is ongoing.
The Harlan County Sheriff’s Office, Constable Jason Blanton and officer Britt Ross also assisted.
