    Grassley proposes amendment 1164 [?]

    Topic: Visa Revocation process changes

Amend - proposes to change way visas are approved by consular officer - non-reviewable - have final say.

    (Uses example of 9/11...)
How to get known terrorist that have made way into US ASAP?

Point: people that have gained access to come, have access to US court system to prevent removal. Prevents access US Courts to stop removal.

Asked Chertoff about problem - said that visitors that misbehave should be asked to leave immediately.

    Why is it important?

2003 GAO report - suspected terrorists could be allowed to stay in country after determination - visas revoked.

FBI suspected terrorist ties in hundreds of visa applications - consular offices not told of this info. Visa already granted, people already came here. GAO found even though visas revoked, visa officials couldn't do anything about situation.

How does it affect us today? Visa officer grants visa - person comes.
[outlines examples..good reasons to revoke a visa.

    3 points about Visa revocation:

    1. Decision to revoke a visa are not taken lightly

    2. Consular don't have auth to revoke a visa based on suspicion. Must have actual finding.

    3. Consular officers must give alien chance to defend and explain self

Currently, aliens can run to steps of our courthouses and take advantage of system. Jeopardized classified INTEL, can force FBI, etc. to share information.

Impacts - info not given to state dept. , If info gets out, damper will take effect.

We need to secure the country.

4 Visa policies about 9/11 attacks:

19 terrorist used 364 aliases - they knew how to play the system.

2 of them obtained fraudulent visas through illegal means

19 terr applied for 23 visas,

    Several lied on visa applications

9/11 Commission - suggests greater control over enty/visa system reqd

Terrorists took advantage before 9/11 - this amendment will be helpful.

    Yields floor...
