    We Should Use the CONSTITUTION to Fight Immigration Issues!

    What if we use the CONSTITUTION to fight the illegal immigration issue? I found this article which has many references to the Constitution on WHO is exactly responsible for immigration issues. It appears that the Constitution has left it to the states to decide. We know the Federal Government has circumvented the states rights to their OWN constitutions on the illegal immigration issue. Maybe we should get a class action suit going and take it to the supreme court! We MUST get it above the state courts because they usually make terrible rulings! Please read!

    Pima County Attorney Barbara LaWall on behalf of herself and several other county attorneys and sheriffs, recently said a Arizona proposed immigration provision is an unconstitutional intrusion by the state into immigration policies, which are solely the purview of the Federal Government.

    This struck me kind of odd because in order to come under the purview of the Federal Government the authority must be found delegated or, incidental to a delegated power granted to Congress under the US Constitution. There is a significant reason why Congress has no delegated power leading to jurisdiction under the US Constitution in matters of immigration or Asylum.

    To better understand why this is so we need to go back to the founding of the United States of America and consider Article II of the Articles of Confederation that read:

    Each state retains its sovereignty; freedom and independence, and every power, jurisdiction and right, which is not by this confederation expressly delegated to the United States, in Congress assembled.

    Wonderful article Jazz...The point STILL remains:
    The Constitution APPLYS to all States of the Union. And, the Soverneignty of this Union... So if OUR ELECTED PUBLIC SERVANTS WILL NOT obied by the Constitution of The United States of America, what are WE THE PEOPLE supposed to do?
    I sometimes think that the Department of Homeland Security was created to protect the members of Govt. and NOT the citizens of this country.

    Patriot I agree with you. The Dept. of Homeland Security is simply a posse cometatus loophole. It does nothing but provide the Federal Government a not so secret police. It's really irritating because its power and existence is linked to 9-11. But in reality, 9-11 could have been prevented, we knew they were planning to attack the WTC, we had info on terrorist muslims who weren't learning to land planes and were linked to terrorist training camps. But the information was not acted upon. The attacks would have been prevented if immigration law was enforced. So I see DHS as an uneeded, unaccountable military force. You can bet they will unleash them anytime they feel their power is threatened. Now, we have 3 globalist candidates of the lowest stature, one of them will inherit this force. Can you imagine what any of them would do with it? The head of DHS now has universal "right" to declare an emergency, there is NO congressional oversight. B. Hussein Obama (as does the others) with a force at his leisure is a scary thought (not letting our Down Syndrome leader off the hook either).

    We have had disaster plans and management strategies for emergencies since the cold war, plans which dealt with massive nuclear strikes and even terrorism. In fact on 9-11 the President was whisked away occording to doctrine written a few decades earlier. Everything worked well. But they have continued to pass these broad powers that grant anti-constitutional intervention in the name of terrorism reaction. It is all too convenient for my taste. These corrupt monkeys took full advantage of the tragedy to expand their powers. Imagine what Bill Clinton would have done with DHS? Imagine what W is doing now? It is the tyrants preatorian guard.

    my point is...

    My point is..we the people are going to have to find a way to get the immigration issue before the supreme court by proving that the Federal Government has NO jurisdiction over the states to enforce it. This really comes down to a group..maybe even ALIPAC that has brought people from ALL the states together for a common cause, to file some kind of class action suit and get it up the chain to the Supreme Court. I bet William and some decent like minded attorneys could figure it out. I'd be willing to donate to the cause of getting the Supreme Court to make a ruling on this...and I bet we would WIN. We just have to find a way to GET it up there.

    As far as I know, ILLEGALS have NO rights under OUR Constitution!

    Are you talking about the same court that brought us the Emergency Medical Treatment & Labor Act (EMTALA) and ruled for the illegals in Plyer vs. Doe? Honestly, I too would like to see some of the illegal immigrant issues come before the U.S. Supreme Court, however, such action would not be without risk. Just saying..........

    We the People have been duped.

    If you really think about what this article says...the Federal Government has NO right to even the EXISTING laws on immigration. That is a STATE issue to be covered by state constitutions! So...technically, we the people need to demand that ALL federal immigration laws be repealed. I know that the State of Florida has very strict laws concerning illegal immigrants..but just look at us! Cubans, Haitains, Mexicans and whoever else are absolutely breaking the backs of the Florida taxpayers because WE THE PEOPLE have been duped into believing Federal Law trumps State Law. This is our own fault for not educating ourselves on the law. the Constitution. The Constitution is the single most powerful tool we have to keep the government's grubby paws off our LIBERTY! It is the responsibility of WE THE PEOPLE to stand up against them and say "STOP!" "NO!". It is not only our responsibility...it is our DUTY to do so. I am READY!!! Come on fellow Americans! Lets DO IT!

    I have thought about this too. That the Constitution really says nothing about "immigration," and therefore the federal government has no jurisdiction over it, and it is delegated to the states. One problem.......This is NOT "immigration" it is an invasion. The greatest invasion in history. The founders did not write that document so that the federal government could not use its resources against an invasion. In fact, they excplicity gave the feds that power in the Constitution.

    Unfortunately...

    Unfortunately the polecats in Washington dont' want to do anything about illegal immigration and we the people are going to have to stop it ourselves. That's all I can figure.

    IMO, leaving responsibility to the individual states is not the answer! Actually, I think that is the absolute worst thing that could happen. The entire nation needs to be singing from the same sheet of music on border security and illegal immigration. Giving each state ultimate control over the issue would be inviting sanctuary states. What we need is for the Federal Government to start holding states and cities accountable for aiding and abetting illegal immigrants.
